Land Use
in the Foothills
In late March, Governor Polis introduced what is being called The Land Use Bill which was then assigned the bill number of SB23-213. From a very high level, this bill looks to address housing needs across the state, specifically, the need for workforce and affordable housing. The scope and breadth of this bill is broad and the reaction to it has been strong. Housing advocates obviously believe that leadership must come from the state level to push the needle on this issue as the action at the local level has been slow or nonexistent. Advocates of local rule strongly argue that this bill oversteps years of planning and zoning regulations that have always been handled at the local level. And then there is a strong contingent that simply does not want this in their neighborhood – often referred to as “NIMBY”. No matter which side of the fence you sit on, there are some technical aspects that I want to clearly point out as we have been receiving many phone calls to the Chamber office on this bill.
The first thing to note is a disclaimer…I write this article about three weeks before it publishes so by the time this article is published, the legislative session will have concluded. Since many conversations are being held at the State House on this bill, amendments are being added to the bill every week, sometimes daily, so I have no idea what this bill will look like in its final form.
The second item to note is that when initially introduced, this bill ONLY addressed municipalities. There was no language addressing unincorporated parts of the state, like Evergreen and Conifer. Through the amendment process that has already taken place, language has been added to allow for ADUs, or Accessory Dwelling Units, to be allowed in unincorporated portions of the state. We shall see if that amendment remains part of the final language of any legislation that is passed. What is an ADU? Think of a separate building on your property that you might build to accommodate your aging parents. That is the most common description of an ADU but obviously could be used as a rental for anyone.
At the writing of this article, there is opposition to this bill in most any form by Colorado Municipal League who have vowed to file a lawsuit if this legislation passes.
Cities and towns, especially in the tourist ski areas of our state, have been on the forefront of the issue of affordable housing as they have struggled to hire enough staff to operate the mountains during ski season. City leaders and officials in those communities are taking a multi prong approach to create more affordable living options for those who work in the tourism industry, but nothing is a quick fix.
Locally, business owners are looking to the mountain cities to our west and many are interested in taking steps now to ensure that we have a local workforce to continue to staff our restaurants, doctor offices, volunteer firefighter association, shops, and recreation centers. These business owners are asking the questions of what can be done in the short-term to create living situations that their employees can afford, and these business owners are meeting with representatives from Jefferson County to understand the barriers in place today. One of the barriers that is often discussed is that the “no” voice is often the loudest voice on every issue.

Common Code Violations: Blocked Exits

Blocked or partially blocked exists are common fire code violations in our community
(and probably across the nation).
Blocked and hidden exits are common in our nation’s historical tragic fires such as those
at the Triangle Waist Company (1911), Rhythm Nightclub (1940), Coconut Grove
Nightclub (1942), Winecoff Hotel (1946), The Station Nightclub (2003), and Cabin Creek
Penstock (2007).
We keep entrances clear so that customers can enter our businesses, but it’s critical that
emergency exits also are free of obstructions. Each exit and walking area leading to
those doors must be clear of furniture, merchandise, garbage, and other obstacles.
Research shows that during an emergency most people will move toward the door they
used to enter the building. They often will pass other available exits, which could slow
their escape and limit choices for survival.
When you enter a building, especially if you plan to stay for more than a few minutes,
look for exit doors.
It’s important for official exits to have code-required signage and for staff to be trained
on how to direct customers and other occupants to the closest exit, even if that exit is in
employee-only areas.

Barbara Sternberg was an Evergreen icon who distinguished herself through her dedication to family, community, service and big ideas. Intelligent, strong, gracious, relational, articulate and positive, hers was a significant impact on the mountain area, fully exemplifying the “lifetime commitment to community service” that is the hallmark of the Evergreen Chamber’s Women’s Hall of Fame.
Born in England in 1923, Barbara met her Czechoslovakian husband Eugene during the war. They emigrated to the U.S. in 1946 and landed in Denver, where Eugene taught architecture at DU and gained renown as a modernist architect and planner. Barbara earned her masters degree in sociology and taught at Colorado Woman’s College and DU. As time went on, the couple welcomed their five children and built a summer cabin on Blue Creek. They eventually moved to Evergreen in 1972, immediately immersing themselves in the community.
Many of us also arrived in Evergreen back in the 70’s, seeking a new way to live our lives and raise our children and earn our keep. We left old values behind, and looked around for new models to point the way in our new community. Like elk in a flower garden, we gobbled up all the good stuff we could find – and so often when we found what we were looking for, there the Sternbergs would be. When we gathered to explore new ideas or welcome citizens from other countries or celebrate milestones, how often was it in the Sternbergs’ great room that the gatherings took place? When we took our children to story hour or do research, it was to a library Barbara helped initiate and design. Like dandelion fluff on a summer breeze, she gently seeded our minds with new perspectives, then recruited us for her newest venture. With her innate decency to inspire us, her bright mind to captivate us, her vibrant energy to motivate us, and her ready humor to lighten us, she made it seem easy. There is a need. Let’s fill it. Together. And let’s get to know each other and enjoy ourselves along the way.
In what she called her “most consciously courageous act,” Barbara was a founding member of the Evergreen Chapter of PFLAG – Parents, Family & Friends of Lesbians and Gays. She and Eugene published Evergreen, Our Mountain Community in 1987, which remains the “go to” resource for all things Evergreen. The book was updated in 1993 and 2004, with proceeds donated to the Kiwanis Foundation. They started Art for the Mountain Community (now Sculpture Evergreen and part of Center for the Arts Evergreen) in 1994 with the mission of placing high-quality sculpture in public places. SE’s rotating Sculpture Walk is a nationwide competition that brings a variety of sculpture to the mountain area every year. In addition, SE maintains a collection of more than 40 permanent sculptures that dapple Evergreen.
Later in life, Barbara became a Jungian psychotherapist with a thriving practice. She also wrote an award-winning historical biography on Anne Evans – A Pioneer in Denver Cultural History, The Things that Last When Gold is Gone. Whether advocating for schools, for women, for racial justice, for gay rights, for mental health or art, her balance of authenticity, heart and reason inspired legions. When Center for the Arts Evergreen launched a capital campaign for a new art center, Barbara stepped up as the first large donor. Nearing her 90th birthday, she even started a blog.
As a public servant, Barbara’s influence was a source of inspiration for Evergreen for decades. But there are other public servants, and there was only one Barbara Sternberg. What set her apart, I think, was the fact that she thought grand thoughts and inspired great works and led us to new expressions of community without ever forsaking her large and lively family. She demonstrated by example that a woman could be a serious professional and community activist without compromising her role as wife, mother, and grandmother. Her life was full with a lively household and a grand home and a thriving career and a sparkling marriage and so many, many contributions to community. It is through that shining example of unflagging dedication to what she held dear that Barbara moved from mortality to immortality, fully deserving of a place in the Evergreen Chamber Women’s Hall of Fame.

Supervisor for the Inspire Program for the special needs population at Evergreen Park and Rec District
-Has worked in this capacity for 29 years (4 years PT before working 25 years FT). Developed the program since 1997.
-Started with 5 participants, now currently 114, ranging in age from 5 to 50; many have been with her for 29 years! She is like family to most of the participants.
-She does EVERYTHING, including driving a 24-passenger bus to make activities possible.
-Highly regarded for the quality program offered for a community the size of Evergreen.
-Disabilities include: non-verbal, feeding tubes, wheelchair bound, Cerebral Palsy, seizures, epilepsy, autism spectrum, Downes Syndrome, Trisomy 18.
The program averages 1 staff person for every 2 participants, and duties include things like changing diapers, personal hygiene, administering meds, transferring from wheelchairs, feeding by hand or tube. Most places no longer offer this service. About half come from outside the district and pay higher fees.
Because it is extremely expensive for programs for the special needs population, fundraising is required. EPRD must raise about $60,000 per year to augment the budget. Maren generally puts in a 60-hour week. She has only 5 assistants – had as many as 17 at one time, but it’s been difficult finding people to fill positions. Instead of cutting programs, Maren has found ways to transport participants to activities in Breckenridge (BOEC) and Winter Park (NSCD) where skilled personnel can integrate them into their adapted programs, i.e., skiing, rafting.
Program offerings include: Special Olympics, special events, camps, field trips, job training, living skills.
Activities include: bowling; swimming; basketball; socializing: getting out to restaurants, movies, museums, theatre performances, dances, sports events; therapeutic horseback riding; adaptive skiing; rafting, fishing; hiking; ropes courses; ziplining; archery; rifle shooting; crafts; team-building activities.
The Inspire Program exists only because of Maren and her amazing staff.
Participants have broadened their positive life experiences enormously because of Maren and her staff.
Families have been able to live more of a normal life because their loved ones with disabilities have trusted programs to attend because of Maren and her staff . It gives parents a reliable “break.”
