THE RIGHT TO CHALLENGE THE IRS's POSITION AND BE HEARD
Every taxpayer has a set of fundamental rights when
to challenge the IRS's position and be heard.
Here are some details about what this right means for taxpayers.
Taxpayers have the right to:
- Raise objections.
- Provide additional documentation in response to formal or proposed IRS actions.
- Expect the IRS to consider their timely objections.
- Have the IRS consider any supporting documentation promptly and fairly.
- Receive a response if the IRS does not agree with their position.
Here are some specific things this right provides taxpayers.
- In some cases, the IRS will notify a taxpayer that their tax return has a math or clerical error. If this happens, the taxpayer:
- Has 60 days to tell the IRS that they disagree.
- Should provide copies of any records that may help correct the error.
- May call the number listed on the letter or bill for assistance.
- Can expect the agency to make the necessary adjustment to their account and send a correction if the IRS upholds the taxpayer's position.
- Here's what will happen if the IRS does not agree with the taxpayer's position:
- The agency will issue a notice proposing a tax adjustment. This is a letter that comes in the mail.
- This notice provides the taxpayer with a right to challenge the proposed adjustment.
- The taxpayer makes this challenge by filing a petition in U.S. Tax Court. The taxpayer must generally file the petition within 90 days of the date of the notice, or 150 days if it is addressed outside the United States.
- Taxpayers can submit documentation and raise objections during an audit. If the IRS does not agree with the taxpayer's position, the agency issues a notice explaining why it is increasing the tax. Prior to paying the tax, the taxpayer has the right to petition the U.S. Tax Court and challenge the agency's decision.
- In some circumstances, the IRS must provide a taxpayer with an opportunity for a hearing before an independent Office of Appeals.
- The agency must do this before taking enforcement actions to collect a tax debt. These actions include levying the taxpayer's bank account. Immediately after filing a notice of federal tax lien in the appropriate state filing location. If the taxpayer disagrees with the decision of the Appeals Office, they can petition the U.S. Tax Court.

Summer Activities
for Kids
Looking for affordable ways to keep your
little ones occupied this summer?
Here are some free and almost free activities
that can be done inside and outside
of the house.
Go Camping. No campground? No problem!
Pitch a tent in the backyard and spend the night underneath the stars.
Construct a backyard obstacle course with hula hoops, jump ropes,
sticks, stones, hoses, and other materials from around the house. Your kids
can take turns completing it—and the person with the fastest time wins a prize!
Have a Taste Test.
Choose an exotic cuisine that your children haven't tried, such as Thai or Brazilian. Find the country on a globe or a map and read a short Internet introduction to that nation's culture. Then make a signature dish from that country for lunch or dinner.
Decorate Rocks. The next time you embark on a hike, have your children
collect rocks. At home, they can decorate the stones with paint, stickers,
markers, glitter, and other art supplies. Display the finished products around
the house, use them as paperweights, or give them to relatives!
Look for shapes in the clouds. Put a blanket in the grass and stare up at the sky. Take turns talking about what you see in the clouds.
Arrange a Scavenger Hunt. What adventurous child doesn't love a scavenger hunt? Whether you set up this free summer activity for kids indoors or outdoors, the objective remains the same: find hidden objects using clever clues.
Host an outdoor movie night. Rent or borrow a movie projector and show a movie on a white sheet draped across PVC pipe in the backyard. Or use the side of your house as the screen. Bring sleeping bags, air mattresses, and pool rafts out as the seating and enjoy the show.
Swap Toys. A "toy swap" is a unique and fun summer activity for kids. Here's how to organize it: Invite friends and neighbors to come over with toys (in good condition) that they no longer want, then let the kids draw numbers to see who gets to pick a "new" toy first.
Water balloon baseball. Sometimes combining two summer activities can make for an exciting way to play outside. Just take a whiffle ball bat and fill up some water balloons. Now you can play baseball with a splash!
Make a time capsule. Have each family member write down something they are grateful for and include a special item in the time capsule. Then store it away until a designated date. You can open it as early as Thanksgiving or as far off as high school graduation.
Have a puzzle race. Use 100-piece puzzles and see who finishes first.
WE HOPE THESE IDEAS HELP YOU HAVE A FUN FILLED SUMMER WITH YOUR KIDS!
