Jean Boler Joins the Team
Senior Attorney

Jean Boler is an experienced lawyer who has worked tirelessly for equity and fairness both as counsel for individuals and organizations. In fact, Jean worked with Larry Schaefer on the precedent-setting sexual harassment class-action lawsuit, Jenson v. Eveleth Mines, which later became the subject of the book Class Action and the movie North Country. As a plaintiffs' employment lawyer, Ms. Boler has used class-action litigation to expose discriminatory patterns in workplaces. As counsel to the City of Seattle, Ms. Boler was at the forefront of helping a willing City government embrace systemic change in its police department.

Law Enforcement Agencies' Social Media Policies Designed To Prevent Controversy

A new "battleground" in the field of employee rights has emerged, and it is a direct result of the prevalence of social media in our society.  Private and public employers are developing policies which restrict employee behavior "off the clock" and particularly an employee's use of social media.

Upcoming Speaking Engagements

March 24, 2016- Larry Schaefer is speaking at St. Thomas at the  MinneAnalytics People Analytics conference on The Risks and Rewards of Using Big Data and People Analytics to Make Employment Decisions.

April 8, 2016- Larry is speaking at the  ABA National Symposium on Technology & Employment Law in Washington, DC. The topic is The Risks and Rewards of Using Big Data and People Analytics to Make Employment Decisions.

April 12, 2016 - Larry is speaking on a Mediation Panel in Minneapolis.

May 17, 2016- Toni Halleen is speaking to a team of internal conflict management employees (mediators) at the Minnesota Department of Corrections. She will present her "Think on the Spot" professional skills training on effective communication and problem solving under pressure.

May 23-24- Larry is chairing two panels at the Upper Midwest Employment Law Institute conference in St. Paul (sponsored by Minnesota CLE). One panel relates to retaliation issues and the second is on LGBTQ rights. Toni will also be presenting legal updates in the plenary session on May 23. Register Here >
Science and Law
Bert Black Enlightens Law Students

On February 18, 2016 Bert Black taught a two hour seminar at the Southern Methodist University Law School on science and the law. It was part of a regular upper-level law school course on expert witnesses. The focus of Bert's session was how courts and lawyers can assess the validity of scientific claims, as required by the U.S. Supreme Court's 1993 decision in Daubert v. Merrell Dow Pharmaceuticals, Inc. He reviewed philosophical issues relating to science, starting with Plato and going through Thomas Kuhn's classic discussions of how scientists themselves determine what's a valid theory. Kuhn was the originator of the term "paradigm shift," and is now considered one of the most important philosophers of the Twentieth Century. After delving into matters philosophical, Bert led the class in a discussion of how various views of science impact the kind of analysis required by Daubert. 


Brian Smith Admitted to U.S. District Court
Schaefer Halleen Attorney Joins Federal Bar

On March 4th, Brian R. Smith was admitted to practice before the United States District Court in an admission ceremony in front of Judge Nelson. Mr. Smith was admitted to the Minnesota State Bar on October 30th, 2015.
