FAR/BAR Contract Revisions- The Municipal Lien Search Change

On April 4, 2017, a new version to the FAR/BAR Contract was unveiled. Among several significant changes is the addition of language set forth in Paragraph 9 (c). The new language now defines a Municipal Lien Search. It is now defined as "a search of records necessary for the owner's policy of title insurance to be issued without exception for unrecorded liens imposed pursuant to Chapters 159 or 170, F.S. in favor of any governmental body, authority or agency".

Effective Now, New Changes to the FAR/BAR Real Estate Contract

As of April 4, 2017, the newest revisions to the FAR/BAR "Residential Contract for Sale and Purchase" have gone into effect. This latest version contains some minor changes as well as a major overhaul of "Paragraph 8 - Financing".
 
It is recommended, but not mandatory, that you start using this new version, known as "FAR/BAR-5 Rev. 4/17." However, keep in mind that older versions of the FAR/BAR contract or any other type of contract for sale and purchase are also legally binding. Therefore, it is important to review the contract being used in your transaction and know what requirements it contains.

NOBODY LIKES TO TALK ABOUT THIS... BUT WE SHOULD CONSIDER TAKING ACTION!

Let's talk about the issue of medical decision-making rights when a person becomes incapacitated, or is left in a persistent vegetative state.

While it is human nature to think that these unfortunate events could never happen to us
or to our loved ones,
the harsh truth is that as long as we are alive, there always exists the risk that some tragic life event could result leaving us in a position of incapacity or reliance on life support.

 Events and medical conditions like this are far more common than we would like to believe.

So what happens to you when the unimaginable happens? The answer to that question largely depends on how well you plan for your future.

Now, back to our question. How do we plan accordingly to have our wishes followed in the event of the unimaginable? The Florida Legislature has enacted Chapter, 765 of the Florida Statutes titled "Health Care Advance Directives" which allows us to make these difficult forward-looking decisions with regard to our health. While the legislature has accounted for those who do not execute a health care surrogate / advance directive1, do we really want to leave these valuable decisions in the hands of the state? -My guess, probably not.
