Final Legislative Update

The 2018 General Assembly adjourned SINE DIE until January 8, 2019 on Saturday, April 14. The 2018 session was one of the most contentious sessions ever. Although the final result included passage of a budget, a tax reform package and a pension bill, many participants left town disappointed.

All eyes are now on the Governor who has until April 26 to decide whether he wants to veto several bills that were passed on the final two days. These bills cannot be overridden by the legislature. Chief among these bills is HB 487 which is a cleanup bill for HB 366. HB 366 is the newly enacted tax package that included an unintended increase in taxes for manufacturers. HB 487 corrects this and it's veto would throw things into chaos. 

HB 465, the Public Protection Cabinet's overhaul of State Boards and Commissions did not pass. We expect the administration to implement the bill by executive order and remain hopeful that the changes we negotiated will remain. House Bill 465 contains a provision that requires the Governor to pick two of the architect members of the Board of Architects from a list of at least three names submitted by the Kentucky Society of Architects. This makes our law consistent with the Engineers and is a change AIA Kentucky has sought for a long time. 

The bill leaves all current boards intact with the same membership they have now. The major changes standardize board procedures, require periodic reviews of board operations and increase the oversight authority of the Public Protection Cabinet. 

We also expect the Interim Joint Committee on Licensing and Occupations to hold hearings on this subject during the interim.

AIA Kentucky scored a big victory on the final day when HB 227, the net metering bill was recommitted to the Natural Resources Committee and did not pass. HB 227 would have sharply curtailed Kentucky's net metering program and made solar power less attractive. Thanks to everyone who made calls and became engaged on this issue. As the clock is ticking before sine die, the Senate Appropriation and Revenue committee approved two committee substitutes cleaning up language in the budget and revenue bills.

The Kentucky House and Senate on Friday voted to override Gov. Matt Bevin's veto of the tax bill the chambers had passed two weeks ago.

Gov. Matt  Bevin,R-Kentucky, has signed the controversial pension reform bill.

Kentucky's new law banning a common procedure for second-trimester abortions was temporarily put on hold when a federal judge signed an order setting the stage for another courtroom battle between the state and the American Civil Liberties Union.

The Kentucky General Assembly voted overwhelmingly on Friday to reject Gov. Matt Bevin's veto of a measure that will give local governments and school districts relief from soaring pension costs this year.

Gov. Matt Bevin, asked Friday about teachers leaving the classrooms to attend a protest rally in Frankfort, said, "I guarantee you somewhere in Kentucky today a child was sexually assaulted that was left at home because there was nobody there to watch them."

A bill which would impose harsher penalties for adults who recruit individuals, including kids, for gangs has been passed by the Kentucky General Assembly on Friday.

As the House of Representatives took to the floor to debate a controversial tax overhaul that generates revenue  in an effort to fund education and pension payments, Gov. Bevin threatened to call them back to Frankfort in a special session if the bills were not fiscally responsible.

Kentucky's ambitious project to build a high-speed internet network across the state could fall through if the legislature does not approve funding this weekend to settle outstanding claims by contractors, according to a bond-rating service.

The Kentucky House of Representatives condemned Gov. Matt Bevin in two separate resolutions criticizing him for his remarks Friday that teacher protests in Frankfort had led to children being sexually abused, harmed or experimenting with illegal drugs.
