ORR Policy Updates
DHS Restrictions on Use of Information Obtained from ORR
On June 10, 2019, we informed you of a restriction in the DHS Appropriations Act, Consolidated Appropriation Act, 2019 (Pub. L. 116-6, Division A, Title II, §224). In addition,
UAC MAP Section 2.2.2
explains how care providers must inform subjects of fingerprint background checks of this restriction.
Congress wrote the restriction to be in effect until September 30, 2019. However,
the restriction remains in effect
while the federal government is under a continuing resolution (CR). The current CR is effective through November 21, 2019 and Congress may enact additional CRs until they are able to pass the appropriations bills necessary to fund the federal government for the full fiscal year.
Therefore, care providers must explain that the restriction remains in effect while the U.S. government is under a continuing resolution. ORR does not know if fiscal year 2020 appropriations bills will contain the same restriction. Congress
may impose the same restriction, different restrictions, or not restrict DHS.
