Client Highlights
Child Custody

Fenwick Thompson & Associates represents a father, whose children were removed from the State of Georgia by the mother and kept from him for 18 months. After 10 months of various service attempts and locating the mother, service was finally perfected on her, while she was residing out-of-state and avoiding service. At the temporary hearing was held on January 3, 2019, the mother was ordered to immediately turn the child over to the father. The client and child were very happy to be reunited.

Child Custody

Fenwick Thompson & Associates successfully argued to maintain jurisdiction in the State of Georgia, at the onset of this Custody case, with a minor child. The child's mother, on her death bed, asked for the child to live with his father in Georgia. The maternal grandmother went to the father's residence, when he was at work, and took the child to live with her out-of-state. Attorney Fenwick Thompson was able to secure physical custody of the child back with the father before the holidays. The father was also awarded permanent legal and physical custody.

Fenwick Thompson & Associates successfully represented a mother, whose children were alienated from her by the father and the father's family for many years. After a long, two-day court battle, the Court found that parental alienation was apparent and ordered that the children be returned to their mother, with counseling.
Legal Updates

Stalking
STALKING PETITION, PROTECTIVE ORDER, 16-5-90, 16-5-91 "A defendant need not engage in unequivocally hostile conduct or make explicit threats in order to be convicted of stalking. Even behavior that is not overtly threatening can provide the requisite degree of intimidation and harassment if it is ongoing, repetitious, and engaged in despite the communicated wishes of the victim..." held the 2nd Division of the Georgia Court of Appeals in  Jenkins v. Jenkins , and even one violation of a protective order may be a violation of OCGA §19-5-91.

Attorney Fees
ATTORNEY FEES, CHANGE OF CUSTODY, MODIFICATION OF CHILD SUPPORT, STATUTORY BASIS REQUIRED If the record does not indicate the exact statutory basis under which attorney fees have been awarded, a trial court's attorney fees order must be vacated and the case remanded, held the 1st Division of the Georgia Court of Appeals in  Jackson v. Brown , because attorney fees can only be awarded if there is a statute authorizing the award.
