Professor Alex Long’s article "The Troublemaker’s Friend: Retaliation Against Third Parties and the Right of Association in the Workplace," 59 Fla. L. Rev. 931 (2007) was recently quoted by the Tenth Circuit of Appeals in a Title VII employment retaliation case. The court cited Professor Long in Reznik v. inContact, Inc. for the idea that courts should adopt a more lenient standard when deciding whether a Title VII retaliation plaintiff engaged in protected activity. Quoting Professor Long, the court adopted “an objective reasonableness inquiry that considers the law against what a reasonable employee would believe, not ‘what a reasonable labor and employment attorney would believe.’”
