George Kuney

Professor George Kuney’s 2018 article, "Understanding and Taming the Doctrine of Equitable Mootness," Norton Annual Survey of Bankruptcy Law, 2018 edition, was cited repeatedly in an amicus brief to SCOTUS, in the case MOAC Mall Holdings LLC v. Transform Holdco LLC, on behalf of a group of law professors and retired bankruptcy judges, including Professor Kuney. The case presents the question “Whether Bankruptcy Code Section 363(m) limits the appellate court’s jurisdiction over any sale order or order deemed integral to a sale order. . .”, and the amici seek reversal of a Second Circuit opinion that embraced a broad conception of statutory and equitable mootness in favor of a more narrow standard. The principal author of the brief is David Kuney, no relation to Professor Kuney, but the only other known “Kuney” in the U.S. that is a long term practitioner in the field of bankruptcy.
