NEW FLSA OVERTIME RULE HAS BEEN ANNOUNCED

On September 24, 2019, after months of anticipation, the U.S. Department of Labor announced the final rule on the overtime provisions under the Fair Labor Standards Act (FLSA).  This rule will be effective on January 1, 2020.  The link below provides detailed information with many additional links at the U.S. Department of Labor.  The U.S. DOL estimates that this rule will make 1.3 million American workers eligible for overtime pay.

The FLSA overtime rule determines whether employees are eligible or exempt for overtime pay. Exempt employees, because of their rate of pay and type of work that they do, are not eligible for overtime pay for hours worked over 40 in a workweek. Nonexempt employees must be paid time and a half for any hours worked more than 40 in a workweek.

Unless exempt, employees covered by the Fair Labor Standards Act must receive at least time and one-half their regular pay rate for all hours worked over 40 in a workweek.

Meeting the salary threshold doesn't automatically make an employee exempt from overtime pay; the employee's job duties also must primarily involve executive, administrative or professional duties as defined by the regulations.

HR Professionals are scrambling in preparation for the January 1st effective date, make sure that you have reviewed your companies policies, guidelines and pay scales to ensure your compliance.

USE THE NEW IRS FITW ESTIMATOR NOW!

Many people were surprised at tax time this year when they learned that they owed taxes.  "How can this happen?  I thought we were getting tax breaks?"

It is entirely possible that most people paid less tax for 2018 than they did in 2017, however they owed taxes for 2018 while receiving a refund for 2017.  That's because along with the tax reductions came reduced withholding tax tables.  That means that people were taking home more in their paychecks and sending less in to the government.  That felt great  . . . . at the time.

We sent out a link last year as the IRS was encouraging employers to help their employees by recommending that they complete the IRS Federal Income Tax Withheld (FITW) Estimator and it is available now for 2019.   This new Estimator makes it easier for people to have the right FIT withheld.  It even allows for users to target a specific desired refund amount, learn which tax credits and deductions they may qualify for, and automatically calculate the taxable amount of any Social Security benefits.

Here's how it works. For most people, the Tax Withholding Estimator requires only 10-15 minutes. Users should have at hand the most recent pay stub for themselves and/or spouse and last year's tax return.
CHANGES FOR THE 2020 W-4 FOR EMPLOYEES
IRS_desk.jpg

The near-final 2020 Form W-4 reveals that employees will have to input many more details than previously.  Changes will include:

  • Worksheets with titles-e.g., "Worksheet 1" and "Worksheet 2" are replaced by "Multiple Jobs Worksheet" and "Deductions Worksheet";
  • A new marital status box for head of household;
  • A checkbox for optional higher withholding (there will be a separate tax table for this);
  • A full-year value of child, dependent and other tax credits;
  • A full-year amount of other (non-wage) income; and
  • A full-year amount of itemized deductions (over the standard deduction amount).
Here is a link to the " DRAFT ONLY " pdf document of the IRS

Please remember to download a new final version of this document when you are ready to distribute to employees and use new tables in 2020.
