There is a lot on their plate this fall before a likely adjournment in December.  ACSA Board Member Nicole Austin (Kings County Distillery, Brooklyn, New York)  and our Washington Lobbyist Jim Hyland (Pennsylvania Avenue Group, Washington DC) did not waste time and got right down to business when Congress returned.  READ MORE

DISCUS brought together many of our small craft distillers to visit the U.S. Congress during its Public Policy Conference.  Speaking with a unified industry voice, DISCUS and ACSA called on Congress to treat us fairly and provide a reduction in the federal excise tax, much like that already enjoyed by small vintners and brewers.

TTB RULES  on the use of "Gluten Free" on Spirits Labels

For distilled spirits made from raw ingredients that never contained gluten (such as fruit) you can go ahead and use the term "gluten free", as long as you are taking proper precautions to make sure the product isn't contaminated by any potentially gluten containing items (such as grain dust). 

For  distilled spirits made from things that DO contain gluten (such as barley, wheat, rye) you cannot use the statement "gluten free" but you CAN use any of the following statements, IF you submit a formula that explicitly identified the distillation process as the way the you "processed" it to remove the gluten and submit  lab results showing less than 20ppm gluten and a detailed description of the method used to remove gluten :
"Product fermented from grains containing gluten and [processed or treated or crafted] to remove gluten. The gluten content of this product cannot be verified, and this product may contain gluten." 
- OR - 
"This product was distilled from grains containing gluten, which removed some or all of the gluten. The gluten content of this product cannot be verified, and this product may contain gluten."

ACSA Appoints Interim Executive Director
August marked the beginning of a return to an association management career for Margie.  She is using the "interim" phase to scale back her workload at the firm in which she practices in the areas of beer, wine, and spirits law and assume management responsibility at ACSA.   Margie's legal career gave her a "heads-up" on many DSP hurdles. From the earliest stages of funding and forming an LLC or corporation, to securing the DSP permit, to maneuvering through the local compliance code and regulations, opening and operating a distillery is not for the faint of heart. The beauty of working within the spirits industry is that life is rarely dull.

UDATES ON FDA SPENT GRAIN RULING 

Specific interpretations on processes such as centrifuging have not yet been issued. 

At this point we will be following this issue closely and pushing to build FDA's awareness of issues faced by craft distilleries. 


If anyone has contact from the FDA we ask you to let us know. We will help you if we can, and the information gleaned from your experience will help others!
