9/11 Victim Compensation Fund
|

With the anniversary of September 11th quickly approaching, Americans will once again pause to remember the lives lost, as well as the heroism and selflessness shown by first responders and all of those who worked hard to save lives that tragic day.
Here at the Jacob Fuchsberg Law Firm, we remember not only the victims of the attack, but the thousands of men and women who have fallen ill as a result of their exposure to the toxic dust and debris at the site. Attorneys Shannon Montgomery and Neal Bhushan lead our VCF team and have represented hundreds of people who became ill or families of loved ones who have passed away, seeking relief from the September 11th Victim Compensation Fund. Our firm was recently featured in Law360 (a widely read legal newspaper), in an article which explored an important decision in one of our medical malpractice cases.
A New York Supreme Court judge denied a doctor’s motion to dismiss fraud claims in a medical malpractice suit, allowing our client to continue her claim for consumer fraud under New York’s deceptive trade practices act (General Business Law § 349). This was a novel ruling based on arguments that we presented, and we were very gratified that the judge ruled this way. Specifically, a neurologist prescribed a high-risk drug to treat our client's multiple sclerosis (MS) without a good medical justification. The reason? The neurologist was receiving large payments from the pharmaceutical maker, Biogen. The complaint alleges that the doctor’s conduct was consumer fraud for his profit rather than a proper medical decision. Our client could have taken standard medications that worked for her in the past. But she became very sick from taking this drug.
In the article, Attorney Jae Oh explained that, “... this decision opens the door to a potential claim that isn’t just medical malpractice… This is one avenue they can use that wasn't necessarily available in the past due to a dearth of case law.” Attorneys Jaehyun Oh, Mark Arnot, and Alan Fuchsberg worked on this case. Ilana S. Wolk joined as an associate attorney in November of 2019. Her practice focuses on matters involving medical malpractice, personal injury, wrongful death, and product liability. She served as a Deputy Attorney General for the State of New Jersey for several years, representing the Division of Child Protection and Permanency in child abuse and neglect cases.

Ilana is highly experienced in a wide array of complex civil litigation matters, including aviation and airline negligence, aircraft product and automobile defects, pharmaceutical defects, class actions and mass torts.
She received her J.D. from Emory University School of Law, and her B.A. in Political Science from The Johns Hopkins University. She is actively involved in the UJA-Federation Young Lawyers Division and JHU Alumni Association. In her free time, she enjoys traveling abroad and cycling.

Amanda Levine graduated from Brooklyn Law School magna cum laude in 2016 and then worked as a staff attorney at the United States Court of Appeals for the Second Circuit from 2016 to 2020. Maya Pendergrass recently graduated from Harvard Law School in May of 2020. She is extremely passionate about social justice and equality. As a new associate, she is focusing on gaining experience in medical malpractice cases and advocating for improving the quality of life of communities receiving inadequate medical treatment.
