In Brief

Welcome to this week’s Members-Only Tuesday Telegraph from the Texas Propane Gas Association (TPGA).

February 20 is a date members need to have on their radar — with more than one important deadline tied to it.

In the first story of the morning, we flag a federal relief measure that expires this week and could impact propane deliveries in Texas.

In the second story, we highlight a statewide race that directly affects propane regulation and oversight.

In the third story, we remind members about an annual compliance requirement with a firm reporting deadline and specific thresholds that may apply to your facility.

We also preview March Meetings in Kerrville, including special guests and timely discussions shaping the months ahead. Hotel reservations and meeting RSVPs must be finalized by the end of this week for those planning to attend.

Don't forget the deadline to submit input on convention training preferences for the 2026 Crossroads Expo & Conference is this week. If you want a voice in what education is offered, now is the time to weigh in.

And in Quick Links, you’ll find timely resources to help keep your operation compliant, informed, and prepared as we move through the remainder of heating season.

Hours Waiver Extended to February 20th

On February 3, 2026, FMCSA extended its 40‑state emergency Hours‑of‑Service waiver—including Texas—through February 20, 2026 (for Texas), due to ongoing winter‑storm impacts. The waiver grants HOS relief for carriers transporting essential supplies like propane.

Railroad Commissioner Wright
Up for Reelection

TPGA is enthusiastically supporting Commissioner Wright's re-election campaign for Railroad Commissioner.

Jim Wright is a lifelong South Texan and a fifth-generation Texas rancher. As such, he understands the important relationship the energy industry has with the citizens of our state and the role energy plays as a cornerstone of the Texas economy.

Since his election to the Railroad Commission in November 2020, Commissioner Wright has been a supportive member of the Texas propane industry.

Commissioner Wright’s endorsements include:

  • Gov. Greg Abbott
  • TXOGA PAC
  • Texas Chemistry Council

Early voting runs from February 17, to February 27, and Election Day is Tuesday, March 3, 2026.

Tier II Reports are due by March 1

Texas propane retailers and bulk storage facilities are reminded to submit their Texas Tier II hazardous chemical inventory reports each year if propane is stored above federal reporting thresholds. Required under the Emergency Planning and Community Right-to-Know Act (EPCRA) and administered in Texas by the Texas Commission on Environmental Quality (TCEQ), Tier II reporting applies to facilities that meet or exceed the reporting trigger at any time during the calendar year.

In Texas, Tier II reports are due by March 1 each year for the preceding calendar year. Facilities should review storage capacities and the maximum amount of propane on-site at any time during the reporting year to determine if reporting is required. Key considerations include:

  • Reporting Threshold: Propane (LP-Gas) triggers reporting at 2,358 gallons (10,000 pounds) present at any one time.
  • Who Must File: Any facility storing reportable quantities, including bulk plants and certain retail locations.
  • Where to Submit: Reports must be filed with the Texas TCEQ Tier II Reporting Program, the appropriate Local Emergency Planning Committee (LEPC), and the local fire department.
  • Agricultural Exemption: Under EPCRA, farms using propane in routine agricultural operations (such as crop drying) on their own farms may be exempt from Tier II reporting.
