ATTN Colorado Dentist: Compliance Check–Have You Filed Your One-Time Compliance Report?

The Environmental Protection Agency (EPA) has promulgated Pretreatment Standards to reduce mercury discharges from dental offices into publicly owned treatment works (POTWs).

If your Colorado dental practice places or removes amalgam (even in limited emergency or unplanned, unanticipated circumstances)

and discharges to a POTW without an approved Pretreatment program (an “unapproved Pretreatment area”), you must submit a One‑Time Compliance Report to the EPA.

Do You Have Experiences With Network Leasing?

The CDA is pursuing legislation in 2026 to address network leasing (sometimes referred to as “umbrella plans”) by dental insurance carriers.

Network leasing is an arrangement where one insurance carrier agrees

to share/lease its dentist network, or a portion of it, with another carrier. This can happen without the informed knowledge of the dentist and has created confusion for dentists and patients, ultimately interrupting patient care.

HIPAA Privacy Update Deadline is Feb. 16, 2026

Beginning Feb. 16, dental offices covered by HIPAA must update their HIPAA Notice of Privacy Practices (NPP) to address the use and disclosure of Protected Health Information received from a Part 2 substance abuse use disorder treatment program under new federal requirements.

To assist practices in meeting this deadline, the ADA has:

Created a checklist to help dental practices comply with needed changes by the Feb. 16 deadline
