CASE OF THE MONTH: The When and How of Charging HST
|
|
Scenario: A kinesiologist is working in a multidisciplinary setting with other health care providers. Should the clinic charge HST for the work done by the kinesiologist?
College response: It depends on the answers to a few important questions:
- Is the kinesiologist practicing kinesiology (seeing a patient within their scope of practice, receiving informed consent from the patient for kinesiology treatment, service or product and/or made an entry, as a kinesiologist, in the patient’s health record) or acting as an assistant under the supervision/authority of another health care professional?
- Why is the patient being seen by the kinesiologist? Is it a referral or part of a continuity of care with other health professionals in the clinic, or did the patient come to the clinic specifically for kinesiology services or treatment?
- Is the kinesiologist an employee of the clinic or are they an independent contractor?
- Is the business considered to be a “small supplier” as defined by the Canada Revenue Agency?
Answers to these questions will help determine if a kinesiologist needs to register for an HST number and charge HST, and if a clinic needs to charge HST for services provided by the kinesiologist.

It is important for kinesiologists to conduct themselves in accordance with all laws and regulations, including those that govern the way they conduct the business and financial aspects of their practice. The College does not claim to have expertise regarding taxation, so we encourage kinesiologists to seek advice from those who do have such expertise (the CRA, the kinesiologist’s accountant and legal counsel). The College does recommend that kinesiologists have some familiarity with the business environment, and would suggest the following resources as good starting points:

Competency profile
Health profession regulators, including the College of Kinesiologists of Ontario, exist to protect the public. In Ontario, many regulatory bodies are beginning to introduce changes to the way they govern themselves to help better serve the interests of the public. One of the key changes is a Council and committees made up of individuals who possess specific competencies. These skills and abilities will help them successfully carry out their duties, support the College’s mandate and safeguard public well-being.
The College strives to create a diverse and inclusive setting that reflects the communities we serve. In the spirit of diversity, equity and inclusion, the College welcomes and encourages the candidacies of kinesiologists from visible minority/racialized, marginalized and rural communities, as well as internationally educated kinesiologists and those practising in expanded, collaborative and/or community health team models. Professional Liability Insurance FAQs |
The start of a new year brings many questions about professional liability insurance (PLI). Many PLI policies expire at the end of a calendar year, and the College receives several questions from kinesiologists about the coverage they should hold. Our FAQs page on PLI answers many of the most-asked questions.
Example questions
Q: What is PLI?
A: PLI protects both kinesiologists and their patients/clients. PLI provides patients/clients with compensation should harm occur as a result of error, omission or a negligent act by a kinesiologist, and it protects the kinesiologist by providing legal and financial support should a claim be made against them.
Q: What are the College’s PLI requirements?
A: Your PLI policy must satisfy the following as defined in the Registration Regulation:
i. a minimum amount of $1,000,000 per occurrence;
ii. a minimum aggregate amount of $3,000,000 per year;
iii. a deductible of no more than $1,000 per occurrence;
iv. where the insurance is of the claims-made type, the member shall have enduring (tail) insurance to provide coverage for at least five years after the termination of the insurance; and
v. the provider must either be licensed as an insurer with the Financial Services Commission or Ontario or must be in the form of membership in a protective association acceptable to the Registrar that provides equivalent protection.
You must provide the College with a copy of your PLI policy at annual renewal and once you’ve renewed your insurance.

This includes changes to your primary email address on file, since email is the College's main way of communicating with registrants.
