Congress is facing a different landscape on their return to Washington this week. Recent military actions in the Middle East have added a new layer of complexity to the already contentious debates in Congress, as negotiations surrounding the “Big Beautiful Bill” continue.
However, in a big win for our advocacy efforts, Senate Parliamentarian Elizabeth MacDonough ruled late Friday that a provision that would shift a portion of the Supplemental Nutrition Assistance Program (SNAP) to states should be struck from the bill. You can read more about the ruling here.
MacDonough made sweeping decisions about what provisions can and cannot be included in the reconciliation package. These decisions are based on the Senate’s Byrd Rule, which prevents policy changes from being included in budget reconciliation bills. Reconciliation bills can be passed with a simple majority, rather than meeting the 60-vote threshold required to pass other bills under debate. To ensure policy changes aren't pushed through using the less rigorous process, the Byrd Rule requires that provisions not directly related to budget matters are removed from reconciliation bill.
