Tennessee Lines up with FMCSA Waivers
On Friday, July 31, 2020, Governor Bill Lee issued a press release, and a new Executive Order both of
which are attached
with the language highlighted, that finally synchronizes the state of Tennessee with the waivers issued by the FMCSA over a month ago.
During that time, some drivers for motor carrier members have received downgrade letters, primarily due to medical certification lapses. This press release and Executive Order, at last, closes that gap. We apologize for any hardship this caused you or your affected drivers.
While this aligns the state of Tennessee with the rest of the country, this new order, along with the one from the FMCSA, is set to expire at the end of September and it is unlikely that the state of Tennessee will extend these waivers even if the FMCSA should decide to do so. It is, therefore, our recommendation that where your operations allow it, that you endeavor to keep up on your drivers physicals, so as to not be subjected to downgrades in the future. The same would go for expiring CDL's.

On Monday, July 20
th
, TTA member and Tennessee State Representative Pat Marsh and Tennessee House Majority Leader William Lamberth, presented a Joint resolution of the Tennessee General Assembly Proclamation to Mal (Red) Rahrer on the celebration of his 90
th
birthday.
The resolution called attention to his military career and the formation of long time TTA member company, Portland Express, in 1966.
Also present at the presentation were Mal’s sons Brad, David and Josh, Dale Eakes, who took this picture, Sumner County Clerk Bill Kemp, Mark Thompson and TTA President Dave Huneryager.
Tennessee trucking industry stories abounded, and, a terrific time was had by all attendees.

Since the onset of COVID-19, our professional truck drivers have been on the frontlines of this fight. We have rightfully earned the recognition of a grateful nation, from every-day Americans on up to the President of the United States. It’s time once again for our industry to lead and show our country how to get the job done.
This pandemic is a crisis not of our making, but overcoming it requires each of us doing our individual part. At this point, masking is the simplest and most effective way to defeat this virus. ATA truck stop/travel plaza members, along with all NATSO members, will begin to require that all customers wear masks in all of their stores.
ATA strongly encourages all fleets to adhere to mask requirements in private truck stops and public rest areas.
Another national shutdown would be catastrophic for our economy and industry, and it’s imperative we avoid that outcome. As we bridge from crisis to recovery, it’s key that we help keep America on the right track.
So let’s mask up—and keep on trucking.

Human Trafficking is a 150 BILLION dollar industry. In the US, a child is sold for sex every 2 minutes. In 2018, 23% of trafficking victims in Tennessee were identified as labor trafficking. The average age of a child sold for sex is 13 yo. (stats from End Slavery Tennessee)
This week is Human Trafficking Awareness Week in Tennessee and July 30 was World Day Against Trafficking in Persons.
Furthermore, truckers are in positions to recognize red flags of trafficking. The TTA and many TTA members companies support

, which is a great resource available to help educate employees.

During the week of July 27-August 2, 2020, the Tennessee Department of Health Reproductive and Women's Health team along with partnering organizations across the state brought awareness and education to the citizens of Tennessee on the growing public health issue of human trafficking. The Red Sand Project is an interactive art exhibition designed to raise awareness of human trafficking. By spreading red sand in sidewalks cracks, the project brings attention to those who have “fallen through the cracks” in society. I
n late June, Governor Bill Lee announced that he will call a special legislative session to take up a legislative measure to protect Tennessee businesses and schools from lawsuits associated with the COVID-19 pandemic. On the last day of session, the General Assembly failed to pass a comprehensive COVID-19 immunity bill, with the effort stalling in the House, after the chambers sparred over a retroactivity provision in the competing versions of the bill. Despite the appointment of a conference committee to resolve the differences between the versions, the chambers were unable to agree on a compromise, with House leadership voicing a number of concerns about the retroactivity aspect of the Senate bill, a component that many in the House believed could render the bill unconstitutional.
There are also rumblings of other potential topics for the special legislative session including a telemedicine bill, consideration of the scope of Governor’s emergency powers, and issues relating to statues and monuments, however, as of now, the scope and timeline and the special session remain unclear. As of late July, the number of confirmed cases of COVID-19 at the legislature among lawmakers and staffs remains at 10, and this total, combined with statewide numbers, will play into the timeline and feasibility of calling the special legislative session, and whether there is agreement amongst the chambers on the COVID-19 liability bill. If it occurs, observers anticipate a date in August after the upcoming primary elections on August 6th.
This month, Governor Lee also issued Executive Order No. 55, which incorporates recently issued federal waivers regarding commercial driver licenses in Tennessee.
