Changes to the Claim Construction Standard for Interpreting Claims in Trial Proceedings Before the Patent Trial and Appeal Board 

The U.S. Patent and Trademark Office (PTO) last week published a final rule that will improve the fairness of patent challenge proceedings. The final rule updates the "broadest reasonable interpretation" standard with a more narrow claim construction standard. BioNJ along with BIO have advocated for these changes since the broadest reasonable interpretation standard was first adopted in 2012. BioNJ supports the implementation of this important final rule, and applauds the PTO for making these essential changes.
