No Free Roofs: Property Insurance Legislation Advances
The House Commerce Committee heard HB 1307, related to Citizens Property Insurance, on Wednesday. An amendment scaled back some of the necessary reforms that would have helped return Citizens to the insurer of last resort, but the bill continues moving. Citizens Property Insurance Corporation is growing by 5,000 policies a week and a recent analysis showed that 99 percent of their premiums were at below market value. This bill would allow companies to take out policies from Citizens if their coverage is similar and the premium is within 20 percent of what is charged by Citizens. The bill would have also removed the glide path, or a cap on annual rate increases, for secondary homes under Citizens. Late last week, two companies were placed in receivership by the Office of Insurance Regulation, and many believe the need to fix Florida’s property insurance market has reached a boiling point. The Consumer Protection Coalition, led by the Florida Chamber, has launched its third grassroots campaign of this session to urge the legislature to tackle other cost drivers in the property insurance market. The Senate companion, SB 1728, will be heard on Monday in the Senate Appropriations Committee and in addition to Citizens Property Insurance reforms, includes language to address fraudulent “free roofs”

- The House and Senate released a joint update on Thursday to announce that budget conference will not begin until next week. The House and Senate budgets are roughly $3 billion apart, and the Legislature uses conference committees to resolve differences. The budget must be finalized by March 8th to meet the 72-hour constitutionally required “cooling off” period to end on time on March 11th.
- A bill that expands non-economic damages in medical malpractice cases passed the House Judiciary committee this week. Florida already has some of the most expensive medical malpractice insurance rates in the country and the Florida Chamber is concerned that HB 6011 would further exacerbate rates. HB 6011 will be heard on the House Floor on Tuesday. The Senate companion bill has yet to be heard in committee.
- HB 569, the Local Business Protection Act, cleared its final committee and is ready for the House Floor. The bill allows local businesses to recover damages if their local government passes an ordinance that results in the business losing at least 15 percent of its profitability – a death knell for almost any local business. The Senate bill, SB 620, has already passed the Senate.
