Updates regarding bills that were filed this Legislative Session.

Turning back the issue at hand, eight (8) of the bills filed this session are by brewers as they renew
their objectives to vertically integrate through expanding into off premise retail. Along the same
lines are a set of bills allowing for direct-to-consumer retail of spirits and permanent “Cocktails to
Go.” There are also four (4) bills that expand the bottle bill to include miniatures, and four (4) bills
increasing the excise taxes on alcohol. Also noteworthy are sixteen (16) bills establishing online
lottery and sports gaming, and fourteen (14) “Home Rule Petitions” allowing specific cities and
towns to increase local license quotas. Bills as filed are listed below:
HB36 (HD36) - An Act establishing an online lottery;
HB37 (HD37) - An Act modernizing Lottery payment options;
HD54 - An Act authorizing the town of Somerset to grant additional licenses for the sale of
alcoholic beverages to be drunk off the premises;
HD78 - An Act promoting the proper disposal of miniatures;
HD118 - An Act to regulate online gaming, daily fantasy, and online sports betting;
HD163 - An Act authorizing the town of Webster to grant additional liquor licenses;
HD244 - An Act authorizing the town of Lunenburg to grant an additional license for the
sale of all alcoholic beverages not to be drunk on the premises to Jaxx Country Variety;
HD279 - An Act regarding licenses for the sale of alcoholic beverages to be drunk on the
premises in the town of Tisbury;
HD280 - An Act authorizing the town of Athol to grant 6 additional liquor licenses for the
sale of alcoholic beverages to be drunk on the premises;
HD466 - An Act providing for alcoholic beverage licenses in the town of Dunstable;
HD687 - An Act authorizing the town of Maynard to grant one additional license for the sale
of all alcoholic beverages to be consumed off the premises;
HD273 - An Act to grant additional liquor licenses for the sale of wines and malt beverages
to be drunk on the premises in Concord;
HD1175 - An Act expanding the sale of products by farmer breweries and pub brewers;
HD1384 - An Act expanding access to craft beer;
HD1563 - An Act relative to carriers of property by motor vehicle;
HD1785 - An Act relative to the wholesale of malt beverages produced by a pub brewery;
HD1786 - An Act relative to the direct sale of alcoholic beverages for off-premises
consumption;
HD1923 - An Act increasing the excise tax on alcoholic beverages;
HD2079 - An Act to regulate sports wagering;
HD2122 - An Act establishing an online lottery;
HD2123 - An Act modernizing Lottery payment options;
SD2365 - An Act to establish sports wagering in the Commonwealth;;
SD2412 - An Act relative to sports wagering in the Commonwealth;
HD2447 - An Act authorizing the town of Dedham to grant four additional licenses for the
sale of all alcoholic beverages, four wine and malt licenses, all to be drunk on the premises,
and one wine and malt package store license to be drunk off premises;
HD2487 - An Act amending Chapter 138;
HD2997 - An Act promoting the proper disposal of miniatures;
HD3606 - An Act authorizing and regulating sports wagering;
HD3786 - An Act to authorize sports wagering in the Commonwealth;
HD3875 - An Act relative to sports betting;
HD4083 - An Act authorizing the town of Clinton to grant a license for the sale of all
alcoholic beverages to Super Sumit, Inc.;
SD157 - An Act expanding the sale of products by farmer breweries and pub brewers;
SD177 - An Act to regulate sports wagering;
SD259 - An Act relative to the proper disposal of miniatures;
SD477 - An Act relative to the fair taxation of alcoholic beverages;
SD718 - An Act to regulate sports wagering;
SD853 - An Act to reduce lottery littering;
SD956 - An Act to create a deposit for glass wine and liquor bottles;
SD1121 - An Act modernizing Lottery payment options;
SD1124 - An Act relative to carriers of property by motor vehicle;
SD1215 - An Act expanding the sale of products by farmer distilleries and wineries;
SD1385 - An Act establishing an online lottery;
SD1436 - An Act relative to liquor licenses in the City of Westfield;
SD1500 - An Act to update the alcohol excise tax;
SD1537 - An Act authorizing the town of Millbury to grant an additional liquor license;
SD1653 - An Act to promote economic recovery for restaurants and bars;
SD1706 - An Act authorizing the town of Wareham to grant an additional license for the
sale of alcoholic beverages to be drunk off the premises; and
SD1934 - An Act relative to the taxation of cider
Now let us address the worrisome bills. Sixteen (16) of the bills filed this session are from big box
retail, Cumberland Farms, and corporate food store chains. These bills are aimed at marketplace
control in Massachusetts. Five (5) bills repeal or provide exceptions to municipal quotas and three
(3) additional bills increase or altogether repeal license caps. There are also four (4) bills allowing
for off premise storage. To be clear, off premise storage is infrastructure to “Alexa get me a beer.”
Finally, there are the usual suspects allowing for coupons, cumulative quantity discounts and
alcohol sales on Thanksgiving. Bills as filed are listed below:
HD63 - An Act returning liquor license control to municipalities;
HD70 - An Act returning liquor license control to municipalities;
HD149 - An Act relative to alcohol sales on Thanksgiving;
HD320 - An Act to promote alcohol storage space;
HD701 - An Act to promote alcohol storage space;
HD1449 - An Act relative to retailer-backed coupons;
HD2181 - An Act relative to the sale of wines and malt beverages by food stores;
HD2964 - An Act further regulating storage of alcoholic beverages;
HD3298 - An Act further regulating certain licenses for the sale of alcoholic beverages;
HD3529 - An Act relative to removing liquor license caps in communities;
HD3718 - An Act further regulating storage of alcoholic beverages;
HD3719 - An Act relative to large project based licenses;
HD3778 - An Act relative to license caps;
SD135 - An Act providing municipal control of liquor licenses; and
SD1351 - An Act relative to the creation of additional business opportunities for alcohol
retailers
The bill of greatest concern is HD3298 - An Act further regulating certain licenses for the sale of
alcoholic beverages. HD3298 progressively increases the cap on Section 15 licenses from 9 to 18
by 2030. The author of HD3298 knew what they were doing as the bill clearly relates to the “2011
Industry Agreement” that has lapsed. HD3778 - An Act relative to license caps, which altogether
repeals caps on licenses, is also worrisome. HD2181 - An Act relative to the sale of wines and malt
beverages by food stores, was introduced by Cumberland Farms and the New England Convenience
Store & Energy Marketer Association.
