In 1986, Congress passed, and President Reagan signed into law, amendments to the federal special education law (IDEA) which provides that parents who prevail in a special education case are entitled to payment of reasonable counsel fees. This provision is critical to families, as it allows our firm to offer free special education consultations in virtually all cases, and in the majority of our cases to handle the matter on a contingency basis where the family does not pay hourly fees as the case proceeds. Rather, MLO frequently takes the risk of prevailing in our cases, which reflects our confidence in the abilities of our attorneys. And in those cases where we cannot assume the full financial risk of prevailing, we often accept a significant portion of the risk of prevailing.
