Senate Passes Bill to Establish Constitutional Right to Hunt, Fish, and Trap in Delaware

DOVER, DE – Senate Substitute 1 for Senate Bill 212, legislation sponsored by Senator Dave Wilson (R – Lincoln) to advance a constitutional amendment recognizing the right to hunt, fish, and trap in Delaware, passed the Senate unanimously Thursday and now moves to the House of Representatives for consideration.


The measure is the first leg of a proposed amendment to the Delaware Constitution that would acknowledge hunting, fishing, and trapping as part of the state’s natural heritage and as preferred methods of wildlife management. The proposal mirrors constitutional protections already adopted in 24 other states.


The substitute bill clarifies that the amendment would not limit trespass or property laws, alter water rights, restrict the State’s regulatory authority over commercial activity, or prevent the suspension or revocation of hunting, fishing, or trapping licenses. It also maintains the General Assembly’s authority to regulate wildlife management using the best available science, including humane methods, licensing requirements, and other conservation practices.


Senator Wilson said the legislation recognizes a longstanding tradition in Delaware while preserving the State’s ability to manage wildlife responsibly.

“Delaware has a proud tradition of hunting, fishing, and trapping that connects generations of families to our outdoors and our natural resources,” said Senator Wilson. “SB 212 makes clear that those rights are valued in our state while fully preserving the Legislature’s authority to manage wildlife based on sound science and conservation needs.”


Supporters of the measure say it provides long term protection for outdoor traditions while maintaining flexibility for modern wildlife management and conservation practices.


“Sportsmen and women across Delaware have consistently demonstrated their commitment to conservation and responsible stewardship of our natural resources,” Senator Wilson added. “This amendment recognizes that heritage and helps preserve it for future generations.”


Because it proposes a constitutional amendment, SS 1 for SB 212 must receive a two thirds vote of each chamber in two consecutive General Assemblies following a general election in order to be adopted.


It now advances to the House of Representatives for further consideration.

Buckson Legislation to Reduce Taxes on Military Pensions Advances in Senate

DOVER, DE — Senate Bill 219 with Senate Amendment 1, legislation sponsored by Senator Eric Buckson (R – South Dover), passed the Delaware State Senate Thursday and now heads to the House of Representatives for further consideration.


SB 219 builds on prior efforts to support Delaware’s military retirees by increasing the state income tax exemption for military pension income. Currently set at $12,500, the exemption will be phased in over three years and increased to $25,000 for all military pensioners beginning in tax year 2029, regardless of age.


Delaware currently remains among the states that partially tax military retirement income, even as 27 states fully exempt it and 12 additional states provide partial exemptions. SB 219 seeks to strengthen Delaware’s competitiveness with neighboring states while recognizing the service and sacrifice of retired members of the United States Armed Forces, including the Coast Guard, Space Force, NOAA Commissioned Officer Corps, and Public Health Service Commissioned Corps.


The bill follows earlier changes enacted in 2022 and 2024 that expanded eligibility and increased partial exemptions for certain military retirees.


“Those who served our country in uniform earned their retirement benefits through years of sacrifice and dedication,” said Senator Buckson.


“Our military retirees chose service to this nation, and many choose to make Delaware their home after they finish that service. We should be working to welcome them, not discouraging them with outdated tax policy.”


SB 219 now awaits consideration in the House of Representatives.

Senate Passes SB 53 to Codify Delaware Farm to Community Program

DOVER, DE — Senate Bill 53, sponsored by Senate Republican Leader Gerald Hocker (R – Ocean View), passed the Delaware State Senate Thursday, would codify the Delaware Farm to Community Program into state law to strengthen local food access, support Delaware farmers, and build long-term resilience in the state’s food supply system.


The Farm to Community Program was launched in 2023 through the U.S. Department of Agriculture’s Local Food Purchase Assistance (LFPA) program. Since its creation, the program has expanded significantly, connecting Delaware farmers with community-based organizations that distribute fresh, locally produced food to residents in need across all three counties.


Today, the program includes 31 farmers, 9 community outlets, and 105 food distribution sites statewide. More than $1 million in local food products has been distributed to Delaware communities through food pantries, senior centers, faith-based organizations, shelters, and other community partners.


Senator Hocker said the legislation protects a successful model that is already delivering results across the state.


“Delaware’s Farm to Community Program has proven to be an effective partnership between farmers and community organizations that strengthens our local food system while helping families in need access fresh, healthy food,” said Senator Hocker. “By codifying this program, we are ensuring it can continue to serve Delawareans regardless of changes in federal funding.”


Hocker added that the program’s success demonstrates the importance of investing in local agriculture and community-based distribution networks.


“This initiative supports our farmers, expands access to nutritious food, and builds resilience into our food supply chain,” Senator Hocker said.


“It is a practical, results-driven approach that benefits both producers and consumers in every corner of our state.”


SB 53 now moves to the House of Representatives for further consideration.
