CBP Issues PPE Guidance, FMCSA Seeks Comments
Business Adaptations in Uncertain Times

Good afternoon,

We are appreciative for the membership feedback about their experiences surrounding the COVID-19 crisis and encourage all to provide photos and stories about what is happening in your companies. Here are some items of interest for your review:

CBP Releases Additional PPE Guidance

U.S. Customs and Border Protection (CBP) has released the attached memorandum regarding the  Presidential Memorandum  on allocating certain scarce or threatened health and medical resources to domestic use. It also provides guidance for the FEMA  Temporary Final Rule  that will be published in the  Federal Register  today, April 10th.

We also received this updated guidance memo from Thomas Overacker, Executive Director, CBP Cargo Conveyance & Security. The memo explains that the intent of the Presidential Memorandum and Temporary Final Rule is to ensure that scarce and threatened personal protection equipment (PPE) remain in the United States for use in responding to the spread of COVID-19, and to prevent domestic brokers, distributors and other intermediaries from diverting such material overseas.

FMCSA Requests Comment on Broker/Forwarder Surety Bond Exemption

On July 6, 2012, the President signed into law MAP-21, which included a number of mandatory, non-discretionary changes to FMCSA programs. Some of these changes amended the financial security requirements applicable to property brokers and freight forwarders operating under FMCSA's jurisdiction. MAP-21 § 32918, (codified at 49 U.S.C. 13906(b) and (c)). More specifically, 49 U.S.C. 13906(b) and (c) require brokers and freight forwarders to provide evidence of minimum financial security in the amount of $75,000. On October 1, 2013, FMCSA issued regulations requiring brokers and freight forwarders to have a $75,000 surety bond or trust fund in effect. 49 CFR 387.307(a), 387.403(c). 78 FR 60226, 602 33.

On Sept. 10, 2019, Small Business in Transportation Coalition (SBTC) submitted a request for a 5-year exemption from the $75,000 broker/freight forwarder financial responsibility requirement for those brokers and freight forwarders with revenues under $15.01 million. FMCSA requests public comment on the SBTC exemption application which may be of interest to AfA members as well.

Have You Completed the AfA CARES Act Financial Relief Package Survey?

Now more than ever, the Airforwarders Association continues to be in close touch with our members so that we can keep you informed and advocating for your interests here in Washington on Capitol Hill and throughout the regulatory agencies. Our frequent surveys enable us to engage you more effectively and we are thankful for your past participation.

Today we want to know if your company has applied for any of the financial assistance programs of the CARES Act and if so, what the experience was like and advice on how we should proceed in our advocacy efforts.

It's a quick survey that should not take more than a minute to complete and we thank you for your participation.

Finally, on behalf of the Board of Directors of the Airforwarders Association, we wish you and your families a happy Easter and happy Passover holiday. This is a challenging time for all of us but our hope is for a safe, and isolated weekend for everyone. Our industry will emerge from this crisis stronger than ever.
