Four Things Hoteliers Should Know About

Of all the disruptions the hotel industry has borne since the start of the COVID-19 pandemic, one of the biggest was the upending of how hotels approach their food and beverage (F&B) programs. One solution that many hotels have implemented is grab-and-go markets, which allow guests to purchase pre-packaged food or meals with limited risk of exposure. Grab-and-go F&B programs have taken off since the start of the pandemic, with many hotels putting their own unique spin on the concept.

Employers May Be Able to Scrap Mask Mandates for Fully Vaccinated Workers

Many are itching to move on from masks, social distancing etc., and the CDC’s announcement is certainly a welcome step, BUT for those employers in California, please remember the following:

The CDC guidance specifically says that “fully vaccinated people no longer need to wear a mask or physically distance in any setting, except where required by federal, state, local, tribal, or territorial laws, rules, and regulations, including local business and workplace guidance.”

California employers are still under the current Cal-OSHA Emergency Temporary Standard (ETS), which makes no accommodation for vaccinated employees when it comes to masking. You can find California’s current guidance and FAQ’s on the ETS here.

We expect that any future revisions to the ETS will be more restrictive than CDC guidance, but stay tuned for future updates.


Retroactive COVID Paid Sick Leave Due When Employee Requests It

I have a business with approximately 40 employees, and I just read something that said California passed a law making COVID sick leave retroactive to January 1 of this year. Is that true? Do I need to go through all my employees’ absence records and pay out this sick leave to employees who were absent during the first quarter of this year?

The answer to your first question is yes. In March of this year, the California Legislature passed SB 95, which provides for supplemental paid sick leave for employees of businesses with more than 25 employees for absences related to COVID-19.

The bill enacted California Labor Code Section 248.2, which, in pertinent part, requires employers to provide up to two weeks of paid time off to employees for absences related to COVID-19.
