2019: A YEAR OF CONCERNS FOR BROADCASTERS?

The midterm general election came and went this week leaving behind a split on Capitol Hill and a few items that broadcasters may want to keep an eye on. The lame duck session, which begins in January, will likely see radio station owner and Congressman Greg Walden (R-OR) turn over control of the Energy and Commerce Committee to Rep. Frank Pallone (D-NJ). Walden has long been an outspoken advocate for broadcasters and will no longer hold the gavel for a Committee that has oversight of the Federal Communications Commission. This could cause some issues as the Democrats promise more oversight in regards to the Commission, ahead of the upcoming quadrennial review. It will also be interesting to see if there will be a push to undo the FCC’s decision to repeal net neutrality regulations adopted during the Obama administration.
In other news, Mike Doyle (D-PA) is poised to succeed Marsha Blackburn (R-TN) as the Chairman of the House Communications and Technology Subcommittee. While Rep. Doyle has supported low power FM, he’s also suggested that pirate stations potentially could offer some segments of the community an outlet to express themselves.
The Local Radio Freedom Act will again be front and center for the February DC fly-in. Jerry Nadler (D-NY) is expected to take the reins as Chairman of the House Judiciary Committee, which would better position him to push through legislation, if enacted, that would create a performance royalty on radio airplay.
Even though these changes give some heartburn to broadcasters, in an interview with
Inside Radio
before voting began, Gordon Smith, President & CEO of the NAB, said he didn’t think the outcome of Election Day would pose significant hurdles for radio or television. “Our issues are not Republican or Democratic,” he said, adding, “I think we’re going to be positioned just fine.”

Even though the mandatory deadline to migrate to an online public inspection file came and went on March 1st, the FCC plans to activate all accounts on November 15th. This could mean fines for those not maintaining their online public inspection file.

Congratulations to Chris Freeland on his successful campaign bid for the 6th District House of Representatives seat in Western Kentucky. Chris promises to be an advocate for broadcasters in the State House.
WKYT-TV RECEIVES SUSPICIOUS PACKAGE
Lexington Police and Fire Departments responded to a call on Thursday regarding a suspicious package that was left at the television station on Winchester Road.

EAS FORM 3 DUE BY NOVEMBER 19TH
A November date for all broadcasters to mark on the calendar is the requirement for the filing of ETRS Form Three, which gives a detailed analysis of the results of the nationwide EAS test conducted on October 3. Stations should have filed Form Two on the day of the test reporting whether or not the test was received. They now need to follow up with the more detailed Form Three report by November 19.
