CLDA is continuing to closely monitor the progress of the PRO Act as it moves through the House of Representatives. Yesterday, Rep. Elise Stefanik (R-NY-21) gave testimony before the House Rules Committee on her proposed amendment to the PRO Act which would have struck the most damaging provisions from the bill. You can see her brief testimony here.
Rep. Stefanik’s key perspective is that the “ABC test is not about addressing misclassification; it is about re-classifying millions of independent workers to fit in the constructs of traditional employment.” As Rep. Stefanik insightfully noted in her testimony, the PRO Act’s nationwide ABC test would rob independent workers of the “flexibility and entrepreneurship opportunities they value, and they choose.”
This understanding of the IC model is in line with CLDA’s view on our industry’s use of contractors. We know that the IC model works for our industry and many others like it. Flexibility, entrepreneurial opportunity, and freedom of choice are essential to the IC model and are valuable things that Congress should not undermine with the passage of the PRO Act. It is important to have a champion like Rep. Stefanik in the House fighting the good fight on these issues. For anyone inspired by Rep. Stefanik’s testimony, a link to donate to her Congressional campaign fund can be found on her website.
CLDA will stay engaged on the PRO Act and will continue to report on our efforts to prevent passage of this bill.
