THIRD TIME'S A CHARM, WHO KNOWS!

This will certainly be an interesting case with an interesting debate inside and outside the legal profession. Because the judge has basically ruled that the NV GEBE SBOD sued the wrong entity. Not the Government, but is NV GEBE they are supposed to be suing. Hence this third injunction case now. But if the shareholder chose to sit in the driver's seat when it comes to the operation of the company, the shareholder can be directly held responsible for the consequences of their action. Now we see a situation in court where the interim manager will be representing the company NV GEBE in court regarding an issue that he basically agrees with, namely that the proposed CEO should not be hired. The only party that wants that done is the shareholder and the shareholder of NV GEBE is the Government of Sint Maarten, represented by the COM, the Council of Ministers, who the judge ruled is not a party to the issue at hand. Are you still able to keep up? Let's simplify a bit more. A supervisory board of a company now has to sue the management board of the same company about an issue they are both in agreement with. TOTAL SCHIZOPHRENIA!
