Illinois Equal Pay Act Information for Employers with 100+ Employees
Earlier this year, the Governor and General Assembly enacted changes to the
Equal Pay Act of 2003.
All private sector employers with 100 or more employees in the state of Illinois are required to report certain payroll information to Illinois Department of Labor and obtain an Equal Pay Act Certificate. This is an aggregate number of employees meaning that if you have three facilities with 40 employees each for a total of 120 employees, you are covered under the new law. Businesses must start submitting applications for Equal Pay Certificates between March 24, 2002, and March 23, 2024, and must recertify every two years.
In order to provide timely information so that employers can remain in compliance, the Department of Labor is seeking to collect contact information for businesses that are subject to these reporting requirements. Employers registered with the Department will receive direct communications with additional information about the law.

If you have 100 or more employees, IDOL is asking that you please provide your contact information no later than November 3, 2021, but it is not required.

Changes to IL Secure Choice Program
Earlier this year, Governor Pritzker signed
P.A. 102-0179 into law that makes changes to Illinois' Secure Choice Savings Program. This new law, which goes into effect on January 1, 2022, makes important changes to the program,
including making it applicable to all employers with at least 5 employees. Previously, the program only applied to employers with 25 or more employees. Other changes to the program include verification for auto-enrollment of employees into the program and automatic annual increases to contribution rates. Coinciding rules also ensure that the program is only available to employees who are 18 years of age and older.
Illinois Secure Choice is a state-facilitated retirement program for employees who do not have a current retirement plan. Illinois Secure Choice has been a priority of Illinois State Treasurer Michael Frerichs and only a handful of states require similar workplace retirement programs. Illinois' program is an opt-out program, meaning all employees without a current workplace retirement program must be automatically enrolled and must opt-out if they do not wish to have their wages deducted for the program.
