The following policy was adopted as new MLS Statement 8.0 in the NAR Handbook on Multiple Listing Policy as approved by the NAR Board of Directors at their November 11, 2019 meeting.
Within one (1) business day of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public facing websites, brokerage website displays (including IDX and VOW), digital communications marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public.
Although NAR requires implementation no later than May 1, 2020,
our
New York State Alliance of MLS’s Board of Managers has decided that l
ocal implementation of this policy will begin on January 1, 2020 and enforcement will begin on February 1, 2020.
This means if you advertise a property that is not entered into the MLS
in any way
within one business day, you are in violation of this policy and you will receive a courtesy notice informing you of this in January. If another of your listings has the same violation, it will be an immediate fine beginning February 1, 2020. All subscribers will receive one courtesy notice on this policy before being fined with those noticed beginning in January.
As part of the New York State Alliance of MLS’s with the Buffalo and Syracuse MLS’s, we will be coordinating the rollout of this new rule across the Alliance and an all member notification will go out very soon with more details about what is included in this rule and how the fines will work. This policy does not pertain to Rentals, New Construction with Multi Units or Commercial listings, including Apartments with 5 or more units.
