In June 2021, the City of Milpitas adopted a law to protect residents from exposure to secondhand smoke in multi-unit housing and in outdoor areas.
As of January 1, 2022, multi-unit housing must be smoke-free, including inside units, balconies and decks; indoor and outdoor common areas; and outdoor areas within 25 feet of doors and windows of multi-unit housing (multi-unit housing means two or more attached units, including apartments, condominiums, townhomes, duplexes, triplexes, etc.).
The following outdoor areas must also be smoke-free:

Outdoor dining areas and parks and trails;

Entryways, outdoor areas within 25 feet of entrances to places where smoking is prohibited, including businesses, retail, offices, grocery stores, and places of worship;

Service areas: such as transit stops, ATMs, entry lines outside of stores; and

Outdoor public events: such as farmer’s markets, parades, music events, etc.
Signs must be posted where smoking is prohibited. The City has a limited number of free “no smoking” signs available. If you would like to pick up a “no smoking” sign, please contact the Planning Department at (408) 586-3279 or planningdepartment@ci.milpitas.ca.gov.
