U.S. Supreme Court Clarifies Burden for Religious Discrimination Claims: "Actual Notice" of a Need for an Accommodation Is Not Necessary

 

In a recent case with Abercrombie & Fitch, the United States Supreme Court made it significantly easier for an applicant or employee to win on a religious discrimination claim involving an employer's alleged failure to provide a religious accommodation. The Supreme Court reversed a lower court's ruling in favor of Abercrombie, and in doing so, rejected the premise that an employer must have "actual notice" of an individual's need for a religious accommodation to be liable for religious discrimination.  READ MORE...
