IFA Advocates for NJ Franchises 


Last week, IFA Senior Director of State & Local Government Relations Matthew Kagel joined representatives from the American Hotel & Lodging Association and IHG Hotels & Resorts for an advocacy day in Trenton, N.J., to discuss S.4202 and A.5050. The legislation would significantly alter long-standing hotel franchise agreements, creating new litigation risks and discouraging future hotel investment in New Jersey.


Why It Matters: The IFA-led coalition met with numerous members of the Assembly, including Assemblywoman Rosy Bagolie, Assembly Deputy Majority Leader David Bailey, Assemblywoman Lisa Swain, Assemblywoman Linda Carter, and Assembly Commerce Committee Chairman William Spearman.

 

What's Next: Following its passage in the Senate Commerce Committee, S.4202 has been referred to the Senate Budget Committee. Meanwhile, A.5050 is awaiting a hearing in the Assembly Commerce Committee. IFA will continue working with bill sponsors, lawmakers, and coalition partners as both measures move through the legislative process.

IFA Law Center Challenges Oregon's Packaging Recycling Law


The IFA Law Center, joined by the Restaurant Law Center, filed an amicus brief on June 15 in NAW v. Feldon, supporting a federal lawsuit to permanently block Oregon’s Plastic Pollution and Recycling Modernization Act.


Why It Matters: Oregon’s packaging law imposes producer fees on franchise businesses that often have little or no control over packaging decisions, creating new costs and administrative burdens without improving recycling outcomes. The law could also deny single-location franchise owners “small producer” status based on brand affiliation rather than independent ownership.


What’s Next: Trial is scheduled for July 13, with a ruling expected later this year. A decision striking down Oregon’s extended producer responsibility (EPR) law could bolster similar legal challenges to EPR laws in other states.
