Guidelines for Temporary Outdoor Dining
Dear Milpitas Restaurant Owners and Managers,

The latest Santa Clara County Public Health Order mandating shelter-in-place and social distancing protocols will allow outdoor dining at restaurants starting Friday, June 5, 2020. To assist local restaurants in setting up temporary outdoor dining areas in a manner that is consistent with county and state health and safety directives, the City of Milpitas has developed Temporary Outdoor Dining Guidelines and will begin accepting applications on Thursday, June 4, 2020, free of charge. In general, outdoor dining areas may be located on sidewalks or patio areas adjacent to the front or sides of a restaurant. Parking spaces may also be used for outdoor dining, provided that temporary barriers such as low decorative walls or fencing, modular concrete or plastic barriers, or landscape planters are installed to ensure the safety of patrons. All areas used for outdoor dining must comply with ADA and other public safety access requirements. In addition, the number of patrons seated at a single table will be limited to six, and seating arrangements must maintain a minimum six-foot seating distance between separate parties. For clarity, patrons who are members of the same household or living unit do not need to be six feet apart when seated together at a table. Prior to setting up tables and chairs for temporary outdoor dining, restaurant owners must submit an application to the City of Milpitas Planning Department and receive confirmation of registration. No fee will be charged for registration, and same-day confirmation is expected for most applications. Submit complete applications to [email protected], and staff will contact the applicant if additional information or modifications are needed.
