EEO-1 Form Deadline Extended; Pay Data Reporting Suspended by White House

Previously announced pay data reporting requirements were suspended by the White House on Aug 29, while the new March 31 deadline will be honored. Employers should disregard the new form, continue to use the old one.

MA Implements Employer Penalties for Employees on Medicaid

Effective January 1, 2018 through calendar year 2019, the Act imposes a temporary employer penalty of up to 5 percent of the employee's wages for each non-disabled employee who receives Medicaid instead of enrolling in employer-sponsored coverage.

MA enacts Pregnant Workers Protection Act

Takings effect on April 1, 2018, this bill extends protections to pregnant workers, including workplace and hiring discrimination, and reasonable accommodations, such as less strenuous workloads and private nursing space.
MA Supreme Court Rules for Employee Fired for Medical Marijuana Use

The Massachusetts Supreme Judicial Court (SJC) has ruled that employers may not fire employees for testing positive for marijuana use in violation of any existing drug testing policies if the employee has a legitimate medical need for medical marijuana.

NY State Issues Final Paid Family Leave Regulations

The law, which takes effect on January 1, 2018, not only gives employees the right to a leave of absence to care for a family member but also guarantees job protection, as well as the right to continue health insurance by paying the premiums while on leave.

Washington State Passes Paid Family Leave Law

Washington State passed a Family Leave Law requiring companies to give twelve weeks of paid leave for either the birth or adoption of a child, as well as other family health reasons. The law will go into effect in 2020.
DOL Overtime Rule Struck Down

A Dept. of Labor Final Rule to raise the overtime pay salary threshold, which was put on hold by a Texas judge in Nov. 2016, has been struck down by the same judge.

Same-Sex Marriage, Domestic Partnerships, and COBRA

Legally married or partnered same-sex couples are now potentially able to ask for health care continuation rights.
