EEO-1 Reporting Period (Mar 18 - May 31)

The U.S. Equal Employment Opportunity Commission (EEOC) will officially open the 2018 EEO-1 survey on March 18, 2019 . The deadline to submit EEO-1 data has been extended until May 31, 2019. Please continue to visit the EEO-1 website for general information about the opening of the 2018 EEO-1 survey

[...] IMPORTANT DEVELOPMENT TO WATCH: A federal judge has reinstated the revised EEO-1 form's pay-data reporting provisions, which were suspended in 2017 by President Donald Trump's administration. The controversial provisions require covered employees to report pay information by race, ethnicity and sex, but the mandate's effective data isn't clear Click here  to read the rest of the article.

Latest Advice on EEO-1 Reporting (As of March 27)

EEO-1 reports, due May 31, are required to include the new Component 2 data consisting of pay and hours-worked data.

While the EEOC is currently accepting EEO-1 reports, its portal does not provide a way to submit this Component 2 data. The EEOC has been ordered to provide employers with more information and a corresponding timeline on plans. Until then, employers are advised to hold off on submitting any information in case this data is required later, in which case it would be easier to submit all data at once. There is also a deadline to prepare its systems to accommodate all required information and to give employers more time to gather the required data. For more information, click here.

Notice of Proposed Rulemaking: Overtime Update
- Wage and Hour Division (WHD)

On March 7, 2019 the Department of Labor announced a proposed rule that would expand overtime eligibility to more than a million American workers.

Under the current law, employees with a salary below $455 per week ($23,660 annually) must be paid overtime if they work more than 40 hours per week. Workers making at least this salary level may be eligible for overtime based on their job duties.

If passed, this proposal would boost the standard salary level to $679 per week (equivalent to $35,308 per year). Above this salary level, eligibility for overtime varies based on job duties.  Read more.

Maintaining and Posting Records

OSHA posting beginning  February 1 for covered employees.

Each February through April, employers must post a summary of the injuries and illnesses recorded the previous year. Also, if requested, copies of the records must be provided to current and former employees, or their representatives. Click here for more information.
