FFCRA Paid Sick and Family Leave Expires, Tax Reimbursement Continues
|
|
New legislation passed by congress in December will not extend employer mandated emergency paid sick and family leave provided by the Families First Coronavirus Response Act, which expired December 31st. Employers are no longer required to provide paid sick and family leave under the previous guidelines of the FFCRA. However, employers who voluntarily continue to offer FFCRA qualifying sick and family leave will continue receiving payroll tax credits until March 31, 2021.
It is important to note there is no new or additional allotment of time. Employees who have used all available leave under the FFCRA are not granted additional time off as a result of the December legislation.
Employers should contemplate COVID-19 related leave scenarios and decide whether they will continue offering COVID-related sick and family leave and consult with tax specialists for information on receiving tax benefits.
If not extending FFCRA leave, employers may wish to review their own leave policies to avoid potential spread of illness.

Missouri Minimum Wage Increase
|
|
The Missouri minimum wage for non-exempt employees increased .85 cents from $9.45 to $10.30 per hour in 2021. An .85 cent increase is set to continue each year through 2023 until $12/hour is reached. Missouri minimum wage does not apply to public employers. Federal minimum wage remains at $7.65 /hr with exception for federal contracts, set at $10.95/hr.
TIPPED EMPLOYEES
Employers are required to pay tipped employees at least 50 percent of the minimum wage, $5.15 per hour, plus any amount necessary to bring the employee's total compensation to a minimum of $10.30 per hour if the employee tips do not cover the additional minimum wage.
OVERTIME COMPENSATION
Overtime compensation must also be paid at a rate of at least one and one-half times a covered employee's regular rate for all hours worked over 40 in a workweek.
EXCEPTION
All businesses are required to comply, except retail and service businesses whose annual gross sales are less than $500,000.

EEOC Guidance:
Can an Employer Require a COVID-19 Vaccine?
|
|
In response to FDA approval and rollout of COVID-19 vaccines in the US, employers are asking to what extent they may require, or at least encourage, employees to receive a COVID-19 vaccine.
The EEOC has now issued guidance clarifying that once a COVID-19 vaccination becomes accessible, employers are lawfully permitted to require employees to be vaccinated before returning to the office, subject to certain limitations and exceptions.
The full guidance addresses when and how employers may require COVID-19 vaccination, and focuses on three topics: (1) accommodations; (2) disability-related inquiries and medical examinations; and (3) the Genetic Information Nondiscrimination Act ("GINA").
