DOL Proposes Limitations on Side Work for Tipped Employees
In June, the U.S. Department of Labor announced a proposed rule seeking to reinstate a DOL policy that employers must pay a minimum wage of $7.25 per hour for tipped employees who spend at least 20% of their workweek on duties that do not produce tips, or if the tipped employee must perform such non-tipped side-tasks for at least 30 continuous minutes.
The policy, colloquially known as the “80/20” rule, was subject to the Trump Administration’s last-minute rulemaking efforts when in December 2020 the Trump Administration issued a Final Rule seeking to extend the $2.13 per hour minimum wage to tipped employees regardless of whether at least 20% of their time was spent on side work.

New Connecticut Law Requires Disclosure of Pay Ranges to Applicants
On June 7th, the state of Connecticut passed a law requiring employers to disclose pay ranges for positions to applicants and employees. The law also expands Connecticut's prohibition of gender-based pay discrimination to require equal pay for "comparable," as opposed to "equal," work. This new law regarding disclosure of salary ranges is among the first such legislation passed on this topic in the United States.
Although this law does not apply in Missouri, the city of Kansas City, MO and multiple other municipalities and states have passed laws in recent years to prohibit employers from requiring pay history, arguing that such requirements perpetuate the gender pay gap between men and women.
For Missouri employers, best practice is to adopt a position salary matrix that is fair and consistent, and relevant to the position, and to phrase your pay offering as “this position’s compensation range is $XXXX”, in lieu of asking pay history questions on the application or during the interview process.
