Affirmative Action


The 60-year-old Executive Order 11246, which required federal contractors to practice affirmative action based on race and gender, has been rescinded by President Trump. The executive order states that the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) is prohibited from “promoting diversity, holding federal contractors and subcontractors responsible for taking ‘affirmative action’, and allowing or encouraging federal contractors and subcontractors to engage in workforce balancing based on race, color, sex, sexual preference, religion, or national origin.”


President Trump’s executive order provides a 90-day grace period, allowing federal contractors to comply with the existing OFCCP regulations.  Affirmative action regulations for individuals with disabilities and protected veterans, file EEO-1 and VETS-4212, must still be followed as well as existing state affirmative action and EEO reporting requirements. 


Due to the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA) and Section 503 of the Rehabilitation Act of 1973, contractors' affirmative action obligations will continue for people with disabilities and veterans. Craig Leen, who was the director of the OFCCP during Trump’s first term, stated that “OFCCP has not been focusing enough on disability and veterans, with very low enforcement recovery numbers in these areas. [The executive order] is an opportunity for the OFCCP to finally do much more to support people with disabilities and veterans, while also continuing to strictly enforce nondiscrimination on all protected grounds.”

With the new administration in office, there are a lot of changes coming to the workplace and its daily operations. SHRM identified 5 issues to stay abreast of:


1.     Regulatory Changes Under a New Administration – Changes that include setting thresholds to remove old regulations before introducing new ones at key federal agencies such as the U.S. Department of Labor and the U.S. Employment Opportunity Commission.


2.     Inclusion, Diversity, and Compliance with Workplace Laws – Agencies are giving increased attention on Title VII and employment practices related to protected characteristics while shifting their approach to inclusion and diversity (I&D).


3.     Workforce Displacement and Skills Gaps Driven by AI – According to research done by SHRM, there are over 19 million current jobs that face significant risk of displacement via automation and the integration of artificial intelligence.


4.     Workforce Participation Gaps – Declining birth rates and an aging population threaten economic growth and productivity.


5.     Employee Well-Being and Benefits – HR professionals should focus on worker productivity, retention, and well-being as work/life integration remains a priority for many employees.


HR professionals can take action by staying informed and adaptable to new rules, policy revisions, and legal challenges that will directly impact workers. It is also important to stay informed on key policies as well as prioritizing upskilling and enhancing workplace flexibility.
