Federal Judge Strikes Down FTC Noncompete Ban
On August 20th, Federal Judge Ada E. Brown “ruled that the FTC didn’t have the authority to issue such a broad action and that the rule was arbitrary and capricious”. Brown expressed that this was due to a lack of evidence as to why the FTC chose to impose such a sweeping prohibition in the first place. This decision against the rule proposed in April is permanent and nationwide.
Many lawsuits against the rule had been filed as employers typically used noncompete agreements to protect trade secrets and other sensitive information. Victoria Graham, the FTC spokesperson, said that the agency is considering a potential appeal, and that the FTC is still able to address noncompetes through case-by-case enforcement actions.

November Election Could Bring Changes to MO
Secretary of State, Jay Ashcroft, certified a ballot measure advanced by the Missourians for Healthy Families and Fair Wages in August of this year. Proposition A asks to gradually increase minimum wage to $15/hr in Missouri as well as guarantee paid sick leave for workers – up to seven paid sick days per year.
This proposition also asks that minimum wage adjustments to be based on changes in the Consumer Price Index each January starting in 2027 and to allow the Department of Labor and Industrial Relations to provide oversight and enforcement. Exemptions and exceptions would include governmental entities, political subdivisions, school districts, educational institutions, independent contractors, service employees who work for a business that makes less than $500,000 per year, and more.
If passed, Proposition A would not change the Constitution but rather Missouri law which means the General Assembly could repeal the measure.

IRS Announces 2025 HSA and EBHRA Contribution Limits and more...
The IRS has now released cost of living adjusted limits for health saving accounts (HSAs), high-deductible health plans (HDHPs), and excepted benefit health reimbursement arrangements (EBHRAs) for 2025.
- HSA Contribution Limits will increase from $4,150 to $4,300 for individuals with self-only HDHP coverage and $8,300 to $8,550 for those with family HDHP coverage.
- HDHP Minimum Deductibles will increase by $50 for self-only HDHP coverage and $100 for family HDHP coverage.
- HDHP Out-of-Pocket Maximums, such as deductibles, copayments, and coinsurance will be $8,300 from $8,050 for self only HDHP coverage and $16,600 from $16,100 for family HDHP coverage.
- The maximum amount for EBHRA Contribution Limit will also increase by $50.
According to EBIA, “EBHRAs are limited-dollar, nonintegrated HRAs that qualify as excepted benefits. They can be offered by employers of any size and must meet specified requirements.” The catch-up contribution limit remains at $1,000 for HSA eligible individuals aged 55 and older.
