Making Sense of Confusing Estate
Planning Terms

Some estate planning terminology can be downright confusing at times. The following is a brief explanation of the difference between a Testamentary Trust and a Sub-Trust:
|

|
Testamentary Trust
–
A testamentary trust is a trust that has been established within a last will and testament or even another, previously established trust. The creation of the testamentary trust is triggered by the death of the person who made the will or previously established trust. A separate trust document is not drawn up and the terms of the trust are governed by the terms of the will or existing trust.
|
|
|
|
Sub-Trust
– A sub-trust can be established under a trust instrument for the benefit of a beneficiary or entity. It is typically used in lieu of outright distributions, which may not be appropriate for certain beneficiaries, such as minors. A separate trust document is not drawn up and the terms of the sub-trust(s) are governed by the terms of the trust instrument.
