Terminating an Employee and Race Discrimination

The facts in this case are fun and saucy, and address concerns that many employers have with former employees taking the company's "secret sauce" or violating a noncompete or other restrictive covenant.


Last month, the United States Senate passed a bill that would bar mandatory arbitration in workplace sexual assault and harassment cases. This is significant for employers. Now is a good time for employers to review their existing arbitration agreements and evaluate whether they should be revised to carve out sexual harassment and sexual assault cases.
