Board of Education Meeting 9/24/26 Recap

Below are the key items discussed during the September 24 Board of Education meeting. It was another long one! Not all items discussed are listed below and these are listed in impact order vs. how they appeared on the agenda.

All votes are marked as ayes-nayes-abstain with the name of the Trustee(s) that was/were in the minority listed.

You can view the agenda for the meeting here. As of the publishing of this newsletter, the recording of the meeting and the meeting minutes are not yet available on the district website.

We have recently launched San Jose VOICE Media on YouTube. You can watch the livestream (we provide video while SJUSD does not) and replays. Follow the page to stay up to date.

High Level Summary of the Meeting

  • Approximately 400 students have left the district for this school year
  • 10% of students from closing schools have left the district
  • The Asset Management Advisory Committee was approved and has their first meeting on October 8
  • Although not yet approved by Trustees, the AI policy in schools has been implemented and teachers have been trained and students are using it

Schools of Tomorrow Update

Chief Business Officer Seth Reddy again presented a slide deck with no information on it. It would be very helpful for him to put substantial data on his slides. He mentioned during the meeting that an updated version of the slides with new numbers will be added when the meeting minutes are posted.

Enrollment

Seth Reddy gave an update on attendance numbers. 2026 - 2027 enrollment numbers will be certified this Wednesday, October 7.

Approximately 400 students have left the district for this school year. Of those,10% (148) of students are from SoT closing schools.

118 students did not get their request for a transfer due to space limitations and 52 students were able to have their transfer request filled. Three students were approved for interdistrict transfers.

According to a parent, quite a few of the Gardner students requested a transfer away from Horace Mann.

Trustee Carla Collins and Trustee Teresa Castellanos were visibly surprised to learn of the number of students who had left the district after the Schools of Tomorrow closures.

Funding for closing schools was doubled to help transition the two communities to build a new one. Additionally, an integration committee will be created to help bring the two communities together.

Bus Transportation

There are currently 211 students taking the bus. If you are interested in having your student take the bus, please reach out to Transportation@sjusd.org.

Pick Up and Drop Off

School pick up and drop off is still an issue at many schools due to the lack of parking space and the roughly doubling of size at 5 different schools. SJUSD said that it's supporting schools with procedures and providing support.

Crossing Guards

Seth Reddy said that they are working with the city of San Jose for crossing guards. One request at Horace Mann for a crossing guard has been approved and other sites are being reviewed including a crossing guard at Washington and one between 10th and 11th for Grant students.

During the SoT process many parents raised concerns about the lack of crossing guards and SJUSD consistently pointed fingers at the city. It is nice to see them finally working with the city to find solutions.

After School Program (ELOP)

All effected students from closing schools who signed up by the deadline were approved for after school care. Additionally, 41 students were enrolled after the deadline and were on the waitlist. 24 of those were not approved for the after school program.

Packing and Moving Process

Faculty and staff had 18 items that needed to be replaced after the move
(either damaged or lost items) and 16 have had their items replaced already. As of the time of this newsletter, the remaining two items should have been replaced.

Staff Parking

Horace Mann wanted expanded parking for employees. Seth Reddy said that the parking garage at 4th Street and St. John was offered for parking but no staff took them up on it. This parking garage is two city blocks from the school!

Seth Reddy also mention that a church around a block from Horace Mann is offering staff 9 parking spots. Our view...staff need to be able to park at the school and not a block or two away. And, why was this issue not resolved before school started?

Asset Management Advisory Committee

The Asset Management Advisory Committee is the group of people who will make the recommendation to the Board about what to do with the 4 closed school sites.

Chief Business Officer Seth Reddy stated that on July 31 an email was sent to all closed school families and on August 20 more information went out to school communities regarding the committee. He stated that on August 11 all neighborhood groups were sent information on the Asset Management Advisory Committee application. Seth Reddy previously stated that there was no way to send out information to non-SJUSD families so it's surprising that he was able to send a large communication out to neighborhood groups.

In total there were 27 applicants and SJUSD decided to select 11 who, in total, represent all categories listed on the application. Additionally, there is at lease one representative from each Trustee area.

Trustee Nicole Gribstad raised questions about if applicants had been verified and if there is a written conflict of interest protocol for the Asset Management Committee. Seth Reddy said no but there were questions on the initial form the applicants filled out related to conflicts of interest.

It should be noted that of the 11 members, 2 were on the Schools of Tomorrow Implementation Committee (STIC), 2 are current SJUSD employees, and two are in construction management or real estate development. One person falls into two of these categories.

Approved 4-1-0 (Trustee Nicole Gribstad)

Details on the Asset Management Advisory Committee can be found here. You can find the list of members and meeting dates here.

AI Policy

District staff presented their new AI Policy. This was listed as an informational presentation with no vote needed at this time.

Associate Superintendent Jody Lax stated that there are different limits based on TK-5, 6-8, and high school and the purpose of the AI policy is "academic integrity."

District staff said that "97% of staff members have completed the module they were required to complete."

Amira has been approved for use in the elementary schools. Amira assesses a student's reading proficiency, fluency, and foundational literacy skills by listening to them read aloud. The recording of students' voices and a computer program doing the student assessment is of real concern. Parents can opt-out of it but there has been no information provided on how to opt-out.

During the presentation it was also stated that information has already been shared with parents. Have you received any information on the use of AI in TK-12? The only information that is available is the new AI webpage that was created but not communicated to families.

Associate Superintendent of Instruction Jodi Lax said that said Gemini is being used in the high schools and that their data is not being used to feed AI models. She also insisted that a policy needs to be in place and it's not an option not to have one and that the District will update as needed. Although she did say that there are limits to elementary schools, she also said that "it is not easy to turn off AI for certain groups of students."

Superintendent Nancy Albarran said that parents have the option to give feedback on the AI policy yet she also didn't mention how feedback should be given.

The student Board member mentioned that her entire high school received information on the use of AI the day before the Board meeting which included how to use it. She asked if the district will have access to student AI chats and are there student limits on chats. Associate Superintendent of Instruction Jodi Lax said "I don't believe we have access to see your work in Gemini." Shouldn't she know for sure?

Trustee Teresa Castellanos said that the new policy is a starting point and that feedback has already been given. She mentioned that the District has the responsibility for AI literacy but we also need to talk about mental health and how our use of AI will impact water and the quality of life. She said "I want the parents to be engaged in that conversation...We need to engage more with our stakeholders and have conversations with our parents." But parents haven't been asked!

Parents voiced their concerns and stated:

  • There needs to be District accountability for using AI
  • Parents should be required to opt-in their students
  • Parents weren't notified that this policy was being brought up
  • Developmentally it's dangerous to use AI on students as young as TK
  • There need to be limits on AI use
  • Parents need to be part of the process
  • There should be a moratorium on the AI policy until there's a thoughtful plan
  • The District is pushing to AP adoption without realizing the impacts of it
  • What are the steps being used and implemented to secure student privacy
  • Los Angeles and New York have put a moratorium on AI use in schools

What's concerning is that on page 8 of the AI Policy presentation, it calls out what has been done, what's in progress, and what needs to be done. The Board has not voted on this new policy so why has so much work already been done prior to approval? Why has there been no transparency with families? The agenda for this Board meeting was the first time an AI policy had been mentioned to families? Parents mentioned that this is yet another example of a lack of transparency, lack of community input, and the District rushing into something without fully understanding the impact

Trustee Reports

Trustee Nicole Gribstad would like to see a three year dashboard for SoT closures with class size, school size, attendance, facility utilization, transportation, and student success. She said that we need a baseline to determine what success looks like. She also asked how will data be analyzed and what will happen if goals aren't being met. Seth Reddy and Superintendent Nancy Albarran pushed back and said that they have a small team that doesn't have time for this work.

She also commented that schools need to teach, writing, and math and that there's somewhere else to study justice and civil rights and that the school district is not to provide political consciousness.

Trustee Teresa Castellanos wants overall achievement of all the schools and is tired of focusing on Schools of Tomorrow closures. She said that she has gone to 3 elementary schools in the last month and said that at the receiving schools the "students are so happy and joyous".

As one parent commented to us, "Trustee Teresa Castellanos and SJUSD is using the resilience of our children as a win for them." This entire process has been a debacle from the beginning. It's shameful that SJUSD is looking at our resilient children as a win when they don't see those same students telling others that they wonder if their new school will be closed next year and where they'll go to school next year. Our children have been greatly impacted by these closures despite the smiles that Trustee Teresa Castellanos says she sees.

Trustee Carla Collins said that the Board needs to get back to the focus of all the schools and not just SoT. She said that we would hire more teachers and support services if we had the money. Because we don't, we have to be creative.

Side note...California requires school districts to have 3% of budget in reserves yet, SJUSD has more than 20% in reserves. They have plenty of money to fund more teachers and support staff. SJUSD chooses not to fund them.

She also commented "I believe in free speech as long as someone isn't intentionally lying." and "I welcome difficult conversation and anyone who is willing to improve public education" She has consistently made comments about community members saying that we are lying, weaponizing our students, and calling us bullies. She was proud to state that she met with one parent since the last Board meeting...one parent.

Trustee Brian Wheatley started his update by thanking Trustee Jose Magana for speaking out against the racist and hurtful Facebook posts that another Trustee (Trustee Nicole Gribstad) had posted. He also said that Trustees need to be respectful in their language to community and speakers. (He was referring to Trustee Carla Collins comments during the last Board meeting) Thank you Trustee Brian Wheatley.

In his report, he asked when updated data for school enrollment numbers will be published and Seth Reddy said they will be updated with the minutes.

Trustee Jose Magana asked for clarification on the 148 number that Seth Reddy mentioned in his enrollment update. Seth Reddy clarified that 148 is the number of all students that are no longer in SJUSD that were at a closing school. (This equals 10% of kids from closed schools left the district.)

Superintendent Nancy Albarran said that the ALA (Academic Language Acquisition) program did not expand past Washington Elementary but it's now bigger because of the consolidations. She acknowledged that there may enough need to have a TWBI program expansion at some of the schools.

Side note...Given the popularity in the TWBI program, it would be great to see it expanded and beyond the downtown, Willow Glen, and Rose Garden areas and possibly with additional languages.

The student Board member impressed many in the community during this meeting. She consistently showed where work was being done within different schools and offered input and suggestions to AI policy review. Thank you, Alex for your thoughtful and insightful input!

Non Agenda Items

Here are some of the key points brought up during the Non Agenda Public Comments by parents and community members.

  • There are staffing shortages in special ed programs. Students are being pushed into group therapy sessions when the recommendation for them is individual sessions. Why is SJUSD doing the bare minimum?
  • A Leland High School water polo coach commented on the poor conditions of the pool and that the Varsity team can't practice there. He stated that it's not an adequate facility and the Board needs to prioritize the pool. He mentioned that all games are away and there has not been a senior night because the pool isn't usable. (This has been a repeat concern that has bee brought to the Board yet they fail to add it to the agenda and say that inspections show that the pool is fine.)
  • The Facilities Master Plan meeting that was held the week before the last Board meeting was not promoted until 24 hours prior to the meeting. Additionally, the social media post regarding it had the wrong date and time.
  • Again, community members brought up the point that 2 minute speeches aren't helpful because it's such a short amount of time to get complex issues discussed.
  • It was requested again to allow speakers to submit questions after 6pm and online.
  • There was a request by a community member to have Trustees host regular townhalls to get community input.

Other Community / Student Concerns

Here are some concerns that we have heard from you. Do you have others? We encourage you to raise these in Board meetings or let us know so that we can raise them for you. Additionally, we encourage you to email your Trustee and let them know what's going on.

  • There is still a call to have SJUSD fully livestream their meetings with video. This was in the Grand Jury report yet SJUSD still refuses to do so. It is incredibly difficult to follow along on Zoom with no video and there's no way to tell who is speaking.
  • Why aren't all school pools ADA compliant?
  • The lack of childcare at the Board of Education meetings hurts parents who can't get a babysitter.
