The U.S. Supreme Court heard oral arguments this morning (10/6/20) in the high-stakes Rutledge v. PCMA lawsuit.
There was a healthy give-and-take between the justices and the attorneys for both parties. Several members of the High Court were skeptical of the seemingly unlimited scope of ERISA pre-emption advocated by the Pharmaceutical Care Management Association. The justices also seemed willing to focus on the fact that Arkansas was not attempting to regulate ERISA plans or benefits but only PBMs and the reimbursement to pharmacy providers. Many of the questions posed by members of the Court focused on the potential effects of a ruling in favor of Arkansas or the effects of a ruling favoring PCMA. Overall, the hearing has given pharmacies reason for optimism about the outcome of the case.
