Notice CPD-20-01: Four-Year Completion Guidance for HOME-Assisted Projects
On January 8, HUD issued a notice providing guidance to HOME participating jurisdictions (PJs) regarding the requirement to complete such projects within four years of commitment of HOME funds (the date of the executed HOME Written Agreement). The notice requires HUD to place warning flags in IDIS to inform PJs when projects are nearing the end of their four-year completion deadline, and notes that the PJ can request a one year extension if requested prior to the completion deadline with sufficient time for HUD processing. The notice also discusses extensions available to PJs to close out completed projects in IDIS when the PJ did not fully draw funds or mark the project as "complete" prior to the end of the four-year completion period.

HUD Published Affirmatively Furthering Fair Housing Proposed Rule


On January 14, HUD published its proposed Affirmatively Furthering Fair Housing rule (85 FR 2041). The agency proposes a new definition of AFFH and the development of metrics to compare jurisdictions. In addition, the notice also establishes new evaluation criteria that may be tied to funding opportunities. Comments are due March 16, 2020. HUD Announces Resident Engagement Initiative for NSPIRE Demonstrations

HUD recently announced two new resident engagement efforts for its National Standards for the Physical Inspection of Real Estate (NSPIRE) Demonstration. First, to establish the best method for inspection, HUD will use either resident input or, if not available, a risk model to select up to five additional units to be included in the NSPIRE Demonstration. Second, HUD seeks best practices in stakeholder engagement, including the use of resident surveys, to integrate resident feedback and other comment into the NSPIRE Demonstration. HUD intends to use these new procedures to improve REAC's responsiveness and understanding of the demonstration.

Fair Housing Act Design and Construction Requirements; Adoption of Additional Safe Harbors

HUD proposes new rules amending HUD's Fair Housing Act design and construction regulations by incorporating portions of the 2009 edition of International Code Council (ICC) Accessible and Usable Building and Facilities standards and by establishing safe harbors for developments that comply with the ICC. HUD also seeks to allow for the future implementation of safe harbors. Comments are due March 16, 2020.

HUD seeks to revise a currently approved information collection consisting of surveys for recipients and providers of HUD technical assistance and training. HUD extends the comment period for its existing request for comments published on November 22, 2019 under President Trump's Executive Order 13978. In response to Executive Order 13878, "Establishing a White House Council on Eliminating Regulatory Barriers to Affordable Housing," HUD seeks public comment regarding barriers to affordable housing development posed by Federal, state, local and tribal laws, regulations, land use requirements, and administrative practices. Comments were originally due on January 21, 2020. The new deadline to submit comments is January 31, 2020.
