Navigating the Full Spectrum of Time-Off Coordination Issues

Jan. 24, 2024
2-3 p.m. CT

As we saw in 2023, the number of states and localities enacting paid leave laws is not slowing down. Employers regularly navigate complex leave situations which can cause a compliance headache when considering the overlap between voluntary policies and obligations under federal, state and local laws. Join us when we discuss several of the common issues businesses face when administering employee leaves. Topics we will cover include:

  • Empowerment in leave options - balancing employee autonomy with state and local mandates;
  • The overlap between employer sponsored plans and state mandated programs;
  • When an employer can request documentation to support a leave request;
  • Employee obligations to provide notice of leave;
  • When intermittent leave can be taken;
  • Compensation during leave, top-off considerations, and other integration of benefits issues; and more!

Compliance in Focus: Managing Accommodation Requests Under the Pregnant Workers Fairness Act and the Expansive EEOC Regulations

Feb. 27, 2024
2-3 p.m. CT

While the Pregnant Workers Fairness Act (PWFA) became effective June 27, 2023, the deadline for the EEOC’s final regulations was months later in December 2023. As a result, employers were left to wonder how the EEOC would enforce and interpret the provisions of the PWFA. Join us as we discuss the final regulations including the following subjects:

  • The physical and mental conditions covered by the PWFA;
  • Requests for reasonable accommodations and the interactive process;
  • Which reasonable accommodations are to be provided “in virtually all cases”;
  • When the temporary elimination of essential job functions to accommodate an employee is required;
  • The ability of an employer to request documentation to support a requested accommodation;
  • The prohibited practices that employers must avoid; and more!

  • Understanding the basics of state and local paid sick leave requirements;
  • Addressing the trend toward “paid leave for any reason” ordinances;
  • Navigating the integration of paid sick leave into paid time off policies;
  • Compliance considerations when using paid time off to satisfy paid sick leave;
