As the Human Resource Risk Manager for ICRMP, I certainly know the challenges of being an HR professional. In my career, I have worked as part of a team & as “HR – Department of One”. I understand & appreciate the hard work & dedication of those of you doing HR for your agencies, whether you are part of a team, a department of one, or wearing many hats. I want to take a moment to recognize outstanding achievements in the field of HR.
Spotlight - Esmeralda Chavez, City of Jerome
Esmeralda began her career at the City of Jerome in December 2013 as Management Assistant to the City Administrator & Economic Development Director. Having just over six months of experience under her belt, she was promoted to City Planner in 2014. Esmeralda enjoyed her work in the planning field for five years. An opportunity came up to learn the human resources position & cross-train with the Human Resources Manager. The cross-training was so successful that Esmeralda & the HR Manager ended up switching positions & Esmeralda took on the HR Manager role for the City of Jerome.
A couple years later, Esmeralda had an opportunity to return to the planning field & she now oversees both human resources & planning & zoning for the City of Jerome as the HR & Planning Services Director. Esmeralda finds her work challenging & rewarding & is very excited to still be involved in both areas. She loves the planning aspect in seeing new development projects come through & being part of the future growth of Jerome as well as being a resource for employees through her human resources role. Esmeralda holds a Bachelor’s degree from Boise State University & she recently obtained her SHRM-CP certification. She grew up in Jerome, Idaho & truly loves serving her community. In her spare time, she enjoys traveling, reading, listening to music & enjoying good food with her family.

Well, another year has come to a close in our great state & I would like to start with extending a Happy New Year to all of you as we kick off 2023!
As all of you know, last year was incredibly busy with regards to your Law Enforcement activities & our work with you on risk management. I cannot say enough about your efforts this past year, both in working together in areas such as training & in reaching out when difficult police actions needed some guidance in the aftermath.
This past year while completing Law Enforcement Assessments, we took your direct input & feedback from both Police Departments & Sheriffs’ Offices & addressed one issue surrounding the high-risk area of restraints.
I am happy to announce our new program available to your agency, The Restraint Risk Management Program. This program makes available funding to help agencies that do not have the resources to purchase an advanced restraint device, the WRAP. Closing out 2022, we were able to purchase that device & cover complete trainer costs for five separate agencies! One of which is pictured here (Homedale Police Department).

Three years ago, the ICRMP Board of Trustees initiated a $5,000 deductible for any employment claims brought against members by current or former employees. Beginning October 1, 2022, the deductible was increased to $20,000. Because of the increasing number of employment claims, the increasing cost of defending them & the increasing risk of large verdicts when cases go to trial Not only may they set a verdict, an employee is entitled to an award of attorney fees even if they win a much smaller amount than they were seeking. These attorney fees could end up being more than 10 times the amount awarded to the employee by a jury.
The ICRMP Board realizes that having to pay a deductible will be difficult for many members, so it provided a way for the deductible to be waived. We call it the “CALL CARL” deductible waiver, which works like this: Before taking action to terminate or suspend an employee without pay, simply pick up the phone & call Carl Ericson, ICRMP’s Risk Management Legal Counsel. If Carl is unavailable, you can also talk to Tammy Middleton, ICRMP’s Human Resources Risk Manager. If the issue is relatively straight-forward, Carl or Tammy will work with you directly. If the issue is more complicated & there are facts that could potentially lead to a claim that the employment action is unlawful, Carl will assign an attorney who is an expert in employment law to assist you.
Please be aware that calling us on the day that you want to take action does not usually allow us time to make a careful evaluation of the situation so please plan ahead to allow sufficient time to evaluate & provide advice. If you follow ICRMP’s [or the attorney’s] advice in making the decision, the deductible will be waived if the employee then pursues a claim against you for the action.

Supervisor Training Series Takes Off
|
|
In 2022, we launched the Supervisor Training Series. This entailed 3 days of in person training focused on skills supervisors need to manage employees. Training topics included how to conduct a legal interview, coaching essentials, documentation, performance management, employee evaluations, disciplinary action & how to prepare for a termination. Students also learned the basics of supervision in Supervisor 101 & Employee Lifecycle. We learned a lot & laughed a lot. Tammy Middleton, Human Resources Risk Manager really enjoyed getting to travel around & meet so many people from our membership.

Sewer Backup?
Advice For Sewer Losses

It’s important if you have word of a sewer loss, that you report it to ICRMP right away, even if you don't have the claim yet. Unlike many other kinds of claims, sewer losses get worse over time. Don’t use phrases like “we’ll take care of that” or indicate that this has happened before, etc. Express empathy & ask them to fill out a tort & tell them that you’ll turn it in to your insurance. We recommend against calling a cleanup vendor on the claimants’ behalf. You are welcome to give the claimant the names of local companies, but the claimant should make the call & sign the paperwork, not the City.
Our practice in most residential sewer losses is we'll start the mitigation process to make sure a residence is safe & the problem won’t continue to get worse, even if we don’t have a liability determination yet. Being involved with the cleanup from the very beginning helps us set expectations with clean up companies & claimants & helps minimize expenses.
There are no absolute defenses to liability, but we have two defenses that have the best luck. The first is someone else interferes with the operation of the sewer. For instance, a contractor washing all the dirt & debris from a construction site into the manhole would be a good defense for us. Juries aren’t as sympathetic to more commonly flushed items such as paper towels or grease.
The other defense is “discretionary function immunity.” This defense is far reaching & can cover many events, but it requires very good planning & record keeping. In the most basic sense, it requires that:
1) You make a plan for the maintenance of your sewer system including jetting & replacement based on budget life & service & recognizing problem areas in your plan;
2) The plan needs to be approved by the governing body & budgeted;
3) You follow the plan which includes keeping a service calendar & logs of completed work.
