Lawsuit Filed Opposing Idaho's 'Abortion Trafficking' Law


Idaho House Bill 242 created a new law termed "abortion trafficking" that punishes an adult who helps a minor seek an abortion in another state or obtain medication to induce an abortion. The law eliminates the pregnant minor's ability to conceal the abortion from the parents or guardian. It punishes any adult with a possible felony charge, punishable by two to five years in prison. However, if a parent or guardian gave permission, the adult who aided the minor could still be prosecuted and use that defense in court, according to the bill text. 


In conjunction with the bill's unclear language and overly aggressive assertions, several advocacy organizations and a civil rights attorney filed a federal lawsuit on Tuesday against Idaho Attorney General Raúl Labrador's office. The plaintiffs argue that the law is too vague to be enforceable and could criminalize an adult providing transportation across state lines to a pregnant minor seeking an abortion. Additionally, they assert that the law violates their First Amendment rights by forcing attorneys to provide patients with limited or potentially misleading information. The lawsuit asks the Idaho District Court to grant a temporary injunction that would block the law from being enforced while the case proceeds.


Idaho's near-total ban on abortions at any stage of pregnancy has exceptions for rape and incest victims who provide a police report documenting the crime and are no more than 12 weeks pregnant. This law is surrounded by several states where abortion is legal, including Washington, Oregon, and Montana. Washington allows minors to obtain an abortion without parental permission, and Oregon requires parental consent for girls under 14.


The law, which took effect May 1, also gives sole discretion to the Idaho attorney general to bring charges if a county prosecutor declines to do so. Legislators who supported the bill and Gov. Brad Little, who signed it into law, framed it as a parental rights bill that did not restrict interstate travel.

Idaho Looks to Restructure Medicaid Funding

Idaho is looking at restructuring how it pays for Medicaid, a free health insurance program that insures about 458,000 Idahoans, costing state taxpayers more than $4 billion last fiscal year.


But there’s mixed evidence that the funding structure that’s used by 41 state Medicaid programs, called managed care, leads to less spending on health expenses or better health care outcomes for patients, a panel of Idaho legislators on the Medicaid Managed Care Task Force heard in presentations Monday at the Idaho Statehouse in Boise.


Idaho’s Medicaid program is currently spread out between various funding structures. 


Dental care, mental health care, and substance abuse treatment are under a managed care structure, where a business contracts with the state to manage patient treatment. Under that system, the state pays a managed care organization a per-member, per-month fee for all people anticipated to receive Medicaid by the state that financial specialists predict before a contract is negotiated. 


That contrasts with a fee-for-service program, which can involve the state health department directly managing patient care, and approving individual fees for individual health care services. But experts note that systems with these titles can vary.

New JZ Modifier for Certain Drugs and Biologicals

Since January 2017, CMS has required the use of the JW modifier to report drug waste. Starting July 1, 2023, you will be required to report modifier JZ on claims where there has been no wastage of a single-dose container or single-use package of the drug or biological administered. 


Audiology Services Not Needing a Referral

Effective July 1, 2023, and implemented on July 3, 2023, audiologists may provide certain tests and services billed under 36 designated codes without an order. CMS finalized 42 CFR 410.32(a)(4) allowing an exception to the treating physician, or NPP, order requirement. This allows audiologists to provide certain diagnostic tests for non-acute hearing conditions and diagnostic services related to implanted auditory prosthetic devices.



Be Up to Date on Prior Authorizations

Don't forget about requesting prior authorization for any Repetitive, Scheduled, Non-emergent Ambulance transport.


Effective July 1, 2023, Facet Joint Interventions will require prior authorization, prior to the procedure when performed in the hospital outpatient department. Starting June 15, 2023, providers can submit their prior authorizations for any procedure dates on or after July 1, 2023. If the procedure is provided in another place of service, prior authorization is not required.
