Two board members of DPBA gave verbal comments asking the Commission to delay approval until DPHP is compliant with existing permits regarding the slip layout being built versus what is approved, and compliance with the correct sizes of day-use boater parking spaces. While our comments fell on deaf ears, the Coastal Commission continues to confirm both items are still under enforcement review.

On the Legal Front
The Appeal of the Summary Judgment on the Boaters' Class Action challenge to the Marina’s price increases is ongoing. The attorneys for Boaters’ Class have filed a Reply Brief, which you can review here. Counsel believes there is a real possibility the Court of Appeal will agree to send this matter back for trial as to the reasonableness of the Marina’s determination as to the proper market price for slip fees. It is anticipated oral arguments will be scheduled soon.
As you can see, a tremendous amount of work went into this appeal by four attorneys and their staff. The attorneys would not have expended this amount of effort if they did not believe the boaters’ position was right. This continued litigation cannot be sustained without your help.
