Talc Update

Since our March 2022 bankruptcy update letter to our talc clients, the Third U.S. Circuit Court of Appeals agreed to review Johnson & Johnson’s controversial move to funnel talc-related liabilities into a new company and then declare that company bankrupt. This appeal follows a federal bankruptcy court’s finding that J&J’s calculated maneuver to bankrupt a newly formed company is allowed under bankruptcy law. Full update.

Paraquat Update

Exposure to the dangerous herbicide Paraquat can cause Parkinson's Disease. We are at the mercy of the court as to the speed with which your case will move through the legal system. The first Paraquat trial is tentatively set for summer 2023 of next year. Therefore, we will likely not have other substantive updates until that time. The litigation process is slow, but we are ready for the fight and appreciate the opportunity to seek justice for our clients harmed by Paraquat exposure. Full update.

Roundup Update

GREAT NEWS! The U.S. Supreme Court denied consideration of Monsanto’s appeal of a jury's $25 million award over claims that Roundup causes cancer. The court’s decision is a major blow for Monsanto. The Smith Law Firm is co-lead counsel on major class action lawsuits happening across the country! These class action lawsuits include actions against McDonalds, Fitbit, and Frickenschmidt Foods. We also are in a class action lawsuit against an Ohio Oil Company on behalf of one-hundred Ohio-based producers of natural gas. Based on preliminary expert estimates, damages could well exceed $1 billion in this case.
