COMMENTARY
Did RCMP Firearms Program Techs Violate the Firearms Act 340 Times?

Since the Liberal government’s May 1st gun ban by Order in Council was announced, computer techs at the RCMP Canadian Firearms Program have reclassified 340 specific firearms as Prohibited.[i]

This raises two issues.

First, the term variant is not defined in the Firearms Act, which means the RCMP Canadian Firearms Program can literally claim anything is a variant of an AR-15, for example, and there is no way to correct the RCMP’s mistake.

For example, the Adler B210, a bolt-action smoothbore shotgun, was reclassified by the RCMP Canadian Firearms Program as Prohibited because, in their bizarre view, this bolt-action shotgun is a variant of the AR-15.[ii]

In similarly idiotic fashion, they reclassified the Saiga 410C Semi-Automatic shotgun as a variant of the Soviet AK-47 rifle.[iii]

Not one part is shared by these two so-called variants and the AR-15 or AK-47. Not one.

Yet because the term is not defined in law and our current government doesn’t care about firearms owners, they get away with this nonsense.

Second, changing a firearm’s classification after one year is a violation of the Firearms Act, making every one of those 340 firearm reclassifications a separate offence.

The Firearms Records Regulations (Classification) state:[iv]

Keeping and amendment of records

  1. Only the Registrar may keep or amend records of determinations made under the Firearms Act that firearms of a particular type, make and model are prohibited firearms, restricted firearms or neither prohibited firearms nor restricted firearms.
  2. The Registrar must keep a record of every determination referred to in section 1 that he or she makes.
  3. The records referred to in section 2 must not be amended more than one year after the day on which they are made and must not be destroyed.

Every time the RCMP Canadian Firearms Program unilaterally reclassified one of these 340 firearms, they blatantly and flagrantly violated the Firearms Act

Every.

Single.

Time.

Our question for Public Safety Minister Blair is quite simple.

Minister Blair, when will you order the RCMP Canadian Firearms Program to abide by the Firearms Act?

PS: We’re not holding our breath waiting for an answer.

RCMP orders him to dispose of rifle

The owner of a Simcoe gun shop has joined a growing list of Canadians challenging the Trudeau government’s recent prohibition on certain makes of rifle.

Dan Nagy, owner of Eli’s Guns and Archery on the Queensway West, filed his paperwork at the Norfolk County court house Monday. He has been provided a date of Sept. 22 to commence proceedings.

“This is how ‘gun control’ works,” Nagy said at the court house. “If you want to prevent drunk drivers from killing sober drivers, you take away the sober driver’s car.”

Ottawa announced a ban on more than 1,500 types of long-arms that look like assault rifles May 1. Public Safety Minister Bill Blair made the move through an order-in-council that changed the definition of legal guns in the Firearms Act.

Some of the lawsuits maintain the ban violates constitutional rights to private property.
Liberals will turn to private sector to organize gun confiscation program

Legal representatives prepared to serve thousands of pages of evidence this week detailing their opposition to the Liberal government’s firearms ban, as lawsuits against the prohibition continue to mount.

Lawyer Edward Burlew, who leads one of five lawsuits now challenging the ban in federal court, is putting forward more than 2,000 pages of evidence on Friday that counter a range of claims cited by the federal government.
They include everything from Ottawa’s use of an order-in-council to enforce the prohibition to specific provisions within the ban to counter arguments about what the firearms included under the ban are actually used for.

Lawyers say the evidence, which includes testimony from 18 citizens and organizations, sets a strong foundation to the five legal challenges now opposing the prohibition.

“The evidence that we have put together, and then we’re going to continue to put together, shows irrefutably that the statements of the Liberal Party and the cabinet members who made this decision to ban these guns is not factually correct,” Burlew said in an interview.

Both the RM of Prince Albert and RM of Buckland are supporting a letter from the City of Cold Lake, Alberta around recent changes to firearms guidelines. At their most recent meeting on Thursday the RM of Prince supported the letter from the city which has been sent to all municipalities in Alberta, Saskatchewan and Manitoba.

“The blanket approach that the federal government has taken with regard to the Criminal Code and firearms does not compute with what happens out here. It does not allow with what people in the western provinces and territories are experiencing,” Reeve Eric Schmalz of Prince Albert said.

At their meeting on Monday, Buckland also supported the firearms Criminal Code Amendment Resolution put forward by Cold Lake.
Latest legal coalition challenging Liberals’ gun ban casts a diverse net

The latest legal action asking the Federal Court to quash the controversial measure includes a sport-shooting mother of three, an assistant attorney with Ontario’s Ministry of the Attorney General, and an Ontario firearm-import company owned by a licensed armourer who sits on a technical committee on firearms attached to Public Safety Canada, the department led by Bill Blair, the leading proponent of the ban.

The last-minute entry into the unprecedented court battle also includes the president of the Burlington Rifle and Revolver Club, the club itself, along with the Montreal Firearms Recreational Centre, known as Centre récréatif d’armes à feu de Montréal Inc. in Quebec.

The Liberals may not wish to be seen talking much about the gun ban over the next few years, as the Nova Scotia shooting inquiry, based on what we already know, could make for an awkward accompaniment

The federal Liberal government may find itself a victim of unfortunate timing: it will be defending its bogus “assault weapons ban” in court just as a public inquiry offers up evidence that such a ban isn’t aimed at the right target.

The May 1 order-in-council that banned several types of rifles — some with numerous variants, all of which were previously legal to own and some of which are owned in significant quantities — is now subject to a series of lawsuits. The National Post reported this week that the suits may be combined into one constitutional challenge. Alberta and Saskatchewan may intervene, as well.

Even if the Liberals are found to be on sound legal footing (given their broad authority in these matters, don’t be shocked if this happens), they’ll find themselves on the defensive for as long as the case takes to resolve.

Alarming Poll: Majority of Voters Think Biden's VP Will Assume Office

U.S.A. –-(AmmoLand.com)- If Joe Biden’s announcement that anti-gun California Sen. Kamala Harris will be his running mate caused alarm among gun owners, a recent Rasmussen survey could ignite a national anxiety attack.

According to Rasmussen, 59 percent of likely voters think “it is likely Biden’s running mate will be president before the end of Biden’s four-year term.” Thirty-nine percent of those respondents think it is “very likely,” the polling firm reported.

The survey was conducted Aug. 6 and 9 with a margin of sampling error of +/- 3 percent.

An earlier Rasmussen survey published June 29 revealed that 38 percent of likely voters believe Biden is suffering “from some form of dementia.” Forty-eight percent disagreed and 14 percent weren’t sure, but that was then.

Right now, 59 percent of Democrats “attach more importance to Biden’s running mate than Republicans (32%), Rasmussen said. Forty-three percent of Independent voters think it’s important.

PolySeSouvient’s Unassailable Logic
on Handgun Bans

On August 8, 2020, PolySeSouvient, one of Canada’s gun ban advocacy groups, put out this tweet:


The implication is the handgun owner is responsible for the theft of his or her handguns, not the criminals.

There is no fault, no blame assigned to the thieves who broke into the house, then into the gun safe to steal these handguns, despite a minimum of three Criminal Code violations before they ever left the scene of the crime.

Nope.

It’s the gun owner’s fault for owning handguns.

According to PolySeSouvient, the solution to criminals breaking into homes and stealing other people’s stuff is to ban anything criminals might want to steal.

By PolySeSouvient’s logic, vehicles are responsible for both drunk drivers and car thieves, kitchen utensils are responsible for obesity, and home owners are responsible for criminals breaking into their houses.

LETTERS – RE: No silver bullet solution to gun crime in Niagara, Aug. 10

This article is a series of contradictions. Karen Vanscoy repeats the tired canard about firearms starting off as legal, and a few paragraphs later describes the illegal shipment of crime guns across the U.S. border, where no Canadian gun registry could have the slightest impact.

In fact, Canada's gun registry did have an impact. It spent billions of dollars without solving a single crime and was generally so useless even the Liberals vowed never to repeat it.

The operative word in “gun crime” is “crime,” not “gun.” Until governments get serious about stopping the flow of crime guns into Canada, drug gangs will choose to protect their trade with illegal guns. Choosing to hang the albatross around the necks of Canada's most law-abiding community — legal and trustworthy firearms owners — might make some people feel better but will have no positive effect.
